A.Anilkumar,     the   learned  counsel<\/p>\n<p>appearing for the petitioner, Smt. Anu Sivaraman, the<\/p>\n<p>learned Government Pleader appearing for the first<\/p>\n<p>respondent and      Sri. Alexander Thomas, the       learned<\/p>\n<p>standing counsel appearing for respondents 2 and 3.<\/p>\n<p>      2. The petitioner was an applicant for appointment to<\/p>\n<p>the post of Police Constable in the Armed Police Battalion in<\/p>\n<p>Ernakulam District.     As per     the notification  inviting<\/p>\n<p>applications, the last date fixed for receipt of applications<\/p>\n<p>was 17-10-2006. According to the petitioner, he had applied<\/p>\n<p>within time. This writ petition was filed, when the petitioner<\/p>\n<p>was not invited to appear for the written test held on 6-9-<\/p>\n<p>2008. By reason of the interim order passed by this Court,<\/p>\n<p>he was provisionally permitted to appear for the written<\/p>\n<p>test held on 6-9-2008.\n<\/p>\n<p>      3. The Kerala Public Service Commission has filed a<\/p>\n<p><span class=\"hidden_text\">WPC 27243\/08                   2<\/span><\/p>\n<p>counter affidavit stating that the application submitted by<\/p>\n<p>the petitioner was received only on 25-10-2007, eight days<\/p>\n<p>after the last date fixed for the    receipt of applications.<\/p>\n<p>Relying on the decision of this Court in Binimil K.G. V.<\/p>\n<p>K.P.S.C. (1997(2) KLJ 477) the Commission contends that<\/p>\n<p>the application submitted by the petitioner cannot be<\/p>\n<p>entertained.\n<\/p>\n<p>      4. As directed by this Court, the learned standing<\/p>\n<p>counsel for the Commission made available to me the<\/p>\n<p>original of the postal cover in which the petitioner had sent<\/p>\n<p>the application along with the original of the application.<\/p>\n<p>Though the application is dated 10-10-2007, the postal<\/p>\n<p>cover in which it was sent to the District Office of the<\/p>\n<p>Kerala Public Service Commission at Ernakulam discloses<\/p>\n<p>that it was received at      Ernakulam for delivery to the<\/p>\n<p>District Officer only on 25-10-2007. The endorsement made<\/p>\n<p>by the District Officer on the original of the application also<\/p>\n<p>shows that it was received only on 25-10-2007. The last date<\/p>\n<p>fixed for receipt of applications was 17-10-2007. The last<\/p>\n<p><span class=\"hidden_text\">WPC 27243\/08                    3<\/span><\/p>\n<p>date was not extended. As the petitioner&#8217;s application was<\/p>\n<p>received belatedly, the Commission was right in rejecting<\/p>\n<p>the application.      In the light of the authoritative<\/p>\n<p>pronouncement of this Court in Binimil K.G. V.
