Court Act praying to set aside the Order passed in the Writ<br \/>\n&#8216;  V  Pe_titi&#8217;On nO.4594\/2004 dated 7.12.2007.<\/p>\n<p>This writ appeai coming On for preliminary hearing, this day,<\/p>\n<p> VEGOPALA GOWDA, J., delivered the fO31Owing:&#8211;<\/p>\n<p>\\\/<\/p>\n<p>J UDGMENT<\/p>\n<p>Accepting the reasons stated in the Miscellaneous Writ, we<\/p>\n<p>have exercised discretionary power and condone the delagi <\/p>\n<p>this appeal by dispensing with issuance of notice to  <\/p>\n<p>as we are not interfering with the orderv-iiiipugne\u00e9d  lappeali<\/p>\n<p>and therefore, no prejudice would be  to <\/p>\n<p>We have heard the learned counselli&#8217;orrthe appellant at &#8220;stage of  V<\/p>\n<p>preliminary hearing itself and pass&#8212;&#8212;-the&#8211;.following&#8221;Judgnient on<\/p>\n<p>merits also.\n<\/p>\n<p>2. The inf &#8216;oftiise learned single Judge is<br \/>\nquestioned   grounds.\n<\/p>\n<p>3. .,CO&#8217;L1IlS&#8217;\u00a72l  appellant submits that the<br \/>\nleairned __i;iudge.lerrevd&#8230;i.n&#8217; affirming the finding recorded by the<\/p>\n<p>Lal:\u00a7&#8217;ou1&#8242;.V.lCourt.V&#8217;regarding the validity of the domestic enquiry is<\/p>\n<p>&#8220;;__erroneoL1s&#8221;&#8216;andAtiierefore, it is unsustainable in law. He further<\/p>\n<p>_F.submits that tnehenquiry held against the workman is not fair and<\/p>\n<p>the order of dismissal is passed by the Disciplinary<\/p>\n<p>&#8216;A&#8217; &#8220;hf H<\/p>\n<p>\\N\/<\/p>\n<p>DJ<\/p>\n<p>4. However, the Labour Court permitted the appellant to<\/p>\n<p>adduce evidence before it giving opportunity to the appellant<\/p>\n<p>herein. The Labour Court, on appreciation of legal  <\/p>\n<p>record, recorded a finding of fact answering the   K V&#8217; <\/p>\n<p>holding that the order of dismissal passed tagairistapplellant.<\/p>\n<p>herein is justified on the basis of the docainlientarylplvevider1ce&#8217;:.iE;:sl.&#8217;g<\/p>\n<p>M&#8211;1 to M&#8211;94 and the evidence of\n<\/p>\n<p>5. The learned singlev-r_I1..idge,p.Ari&#8217;1*&#8217;1  ofljudieial review<br \/>\npower, has examined the correc__tnes~s  passed by the<\/p>\n<p>Labour Court having.pre&#8211;garci-Vito\u00bbthe_:gro_unds&#8217;2\u00abdrged in the writ<\/p>\n<p>petition. The La..~boi1_r_li{3o&#8217;gzrt;-._V-.b:eing&#8221;7_ah&#8217; fact \ufb01nding Court, on<\/p>\n<p>appreciation: of  record, has held that the<br \/>\nDisciplinary  in dismissing the workman<br \/>\nfrom servigee as lltiiefchargesvlare proved by the disciplinary<br \/>\n  Labour Court is not shown to be<\/p>\n<p>either. erroneous orfarpbitrary in law. Therefore, the learned single<\/p>\n<p> I&#8217;igh_ltlyv_.accieptled the findings and reasons recorded on the<\/p>\n<p> of dispute and rejected the writ petition holding that the<\/p>\n<p> _l_ev&#8217;eled against the workman are proved and he is not<\/p>\n<p>H for any relief. Learned single Judge has held that framing<\/p>\n<p>o\u00bbf..l.eharges is perfectly based on proper appreciation of legal<\/p>\n<p>&#8216; &#8220;evidence on record. \\N\/<\/p>\n<p>6.
