        The petitioners were found guilty for the offences<\/p>\n
under   Sections   341,   323,   447   and   354   of   the   Indian<\/p>\n
Penal   Code   and   they   were   sentenced   to   undergo   simple<\/p>\n
imprisonment for various terms           by   the   trial   court.\n<\/p>\n
On appeal, the Appellate Court confirmed the conviction<\/p>\n
and sentence.\n<\/p>\n
        2.     Crl.M.Appl.No.11897   of   2006   was   filed   by   the<\/p>\n
revision   petitioners   as   well   as   Pws.1   and   2   seeking<\/p>\n
leave   to  compound  the  offence  and  that  application  was<\/p>\n
allowed.\n<\/p>\n
        In   the   result,   the   Criminal   Revision   Petition   is<\/p>\n
allowed,   the   conviction   and   sentence   imposed   on   the<\/p>\n
petitioners   are   set   aside   and   the   petitioners   are<\/p>\n
acquitted   under  Section  320(8)  of  the  Code  of  Criminal<\/p>\n
Procedure.\n<\/p>\n

        This  is an  application  filed  under Section  320<\/p>\n
(6)   of   the   Code   of   Criminal   Procedure,   seeking<\/p>\n
leave   to   compound   the   offence.       The   petitioners<\/p>\n
were   found   guilty   for   the   offences   under   Sections<\/p>\n
341,   323,   447   and   354   of   the   Indian   Penal   Code.\n<\/p>\n
The   application   is   signed   by   PWs.1   and   2,   who   are<\/p>\n
the  injured.    The  second  respondent  is  the  defacto<\/p>\n
complainant.    It  is  stated  in  the  application  that<\/p>\n
the  matter  is  settled  between  the  parties  and  that<\/p>\n
respondents   2   and   3   have   no   further   grievance   in<\/p>\n

     This   is   an   application   for   condonation   of   the<\/p>\n
delay   of   eight   days   in   filing   the   Revision.     The<\/p>\n
judgment   impugned   in   this   Revision   is   dated<\/p>\n
27.5.2006.     The   conviction   and   sentence   imposed   on<\/p>\n
the   revision   petitioners\/accused   were   confirmed   in<\/p>\n
the appeal.  Therefore, they were entitled to get a<\/p>\n
free   copy   of   the   judgment   of   the   Appellate   Court<\/p>\n
under   Section   363(1)   of   the   Code   of   Criminal<\/p>\n
Procedure.  Free copy of the judgment was issued on<\/p>\n
7.7.2006.     In   view   of   the   decision   in  Ouso   and<\/p>\n
others v. Cheekka and another  (Unnumbered Crl.R.P.\n<\/p>\n
Of   2006   against   Crl.A.No.279   of   2005),   there   must<\/p>\n
be endorsement on the free copy as to when copy was<\/p>\n
ready,   the   date   notified   to   receive     the   copy   and<\/p>\n

the date notified for delivery.  Since the relevant<\/p>\n
endorsements   are   not   there   on   the   copy   issued   to<\/p>\n

for filing the Revision.   Hence, I hold that there<\/p>\n
is   no   delay   in   filing   the   Revision.             The<\/p>\n
application is unnecessary and it is closed.\n<\/p>\n
