Sra, DAG Punjab.\n            ***\n\nARVIND KUMAR, J.\n<\/pre>\n<p>            The petitioner is seeking quashing of FIR No. 34 dated<br \/>\n24.2.2003, under Sections 420, 406, 120-B IPC, registered at Police Station<br \/>\nSubhanpur, Tehsil and district Kapurthala and consequent proceedings<br \/>\nthereto, on the basis of compromise entered between the parties<br \/>\n            It has been contended that the impugned FIR was got lodged by<br \/>\nrespondent No.2 against the petitioner and now with the intervention of<br \/>\nrespectables, both the parties have settled all their dispute and the<br \/>\ncomplainant, who has been paid all the dues by the petitioner has decided<br \/>\nnot to pursue the impugned FIR registered against the petitioner.      The<br \/>\naffidavit (Annexure P-2) of the complainant containing the recitals of the<br \/>\ncomplainant being paid back the amount and         his no objection to the<br \/>\nquashing of the FIR against the petitioner has also been placed on record.<br \/>\nEven, learned counsel for respondent No.2 has stated that, as per his<br \/>\ninstructions received from respondent No.2, the complainant has no<br \/>\nobjection in quashing of the impugned FIR in the wake of compromise<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>entered between the parties. .\n<\/p>\n<p>            By now it is fully settled that the High Court in exercise of<br \/>\ninherent powers can quash the proceedings if it finds that allowing of any<br \/>\nsuch proceedings to continue would be an abuse of process of the Court or<br \/>\nthat ends of justice require that the proceedings be quashed. In the case of<br \/>\n<a href=\"\/doc\/548497\/\">State of Karnataka v. L. Muniswami, AIR<\/a> 1977 SC 1489, the Hon&#8217;ble<br \/>\nSupreme Court has observed that the ends of justice are higher than ends of<br \/>\nmere law, though justice has got to be administered according to the laws<br \/>\nmade by the legislature yet the Court proceeding ought not to be permitted<br \/>\nto degenerate into a weapon of harassment or persecution.\n<\/p>\n<p>            In the case of <a href=\"\/doc\/297418\/\">Mrs. Shakuntala Sawhney v. Mrs. Kaushalya<br \/>\nand others<\/a> 1980(1) SCC 63, the essence of compromise has been summed<br \/>\nup in following words:-\n<\/p>\n<blockquote><p>                   &#8221; The finest hour of justice arrives propitiously when<br \/>\n                   parties, despite falling apart, bury the hatchet and weave<br \/>\n                   a sense of fellowship of reunion.&#8221;<\/p><\/blockquote>\n<p>            The Larger Bench of this Court in the case of Kulvinder Singh<br \/>\n&amp; Ors. Vs. State of Punjab &amp; Anr. 2007(3) RCR (Criminal) 1052, while<br \/>\ndiscussing the scope of quashing of prosecution on the basis of compromise,<br \/>\nby this Court in exercise of powers under Section 482 Cr.P.C., even in non-<br \/>\ncompoundable offence(s) has held as under:-\n<\/p>\n<blockquote><p>                   &#8220;28.   The compromise, in a modern society, is the sine<br \/>\n                   qua non of harmony and orderly behaviour. It is the soul<br \/>\n                   of justice and if the power under Section 482 of the<br \/>\n                   Cr.P.C. is used to enhance such a compromise which, in<br \/>\n                   turn, enhances the social amity and reduces friction, then<br \/>\n                   it truly is &#8220;finest hour of justice&#8221;. Disputes which have<br \/>\n                   their genesis in a matrimonial discord, landlord-tenant<br \/>\n                   matters, commercial transactions and other such matters<br \/>\n                   can safely be dealt with by the Court by exercising its<br \/>\n                   powers under Section 482 of the Cr.P.C. in the event of<br \/>\n                   a compromise, but this is not to say that the power is<br \/>\n                   limited to such cases. There can never be any such rigid<br \/>\n<span class=\"hidden_text\">                                       3<\/span><\/p>\n<p>                   rule to prescribe the exercise of such power, especially in<br \/>\n                   the absence of any premonitions to forecast and predict<br \/>\n                   eventualities which the cause of justice may throw up<br \/>\n                   during the course of a litigation.\n<\/p><\/blockquote>\n<blockquote><p>                   29.     The only inevitable conclusion from the above<br \/>\n                   discussion is that there is no statutory bar under the<br \/>\n                   Cr.P.C. which can affect the inherent power of this Court<br \/>\n                   under Section 482. Further, the same cannot be limited to<br \/>\n                   matrimonial cases alone and the Court has the wide<br \/>\n                   power    to   quash    the   proceedings      even   in   non-<br \/>\n                   compoundable offences notwithstanding the bar under<br \/>\n                   Section 320 of the Cr.P.C., in order to prevent the abuse<br \/>\n                   of law and to secure the ends of justice.&#8221;<\/p><\/blockquote>\n<p>            In the instant case, as emerges from record, the parties have<br \/>\nmutually settled their dispute and the petitioner has cleared all his dues<br \/>\npending towards the complainant and thus, have put to rest their litigation.<br \/>\nThe complainant, the star witness of the prosecution has since decided to<br \/>\nwithdraw from the prosecution, this Court is of the considered view that<br \/>\ncontinuance of such a prosecution is nothing but an exercise in futility and<br \/>\nsheer wastage of time of Court. Therefore, considering the aspect of<br \/>\nsettlement having arrived at between the parties, it is a fit case where<br \/>\ninterference of this Court in exercise of its inherent powers under Section<br \/>\n482 Cr.P.C. is made out.\n<\/p>\n<p>            Therefore, in view of the discussion above, the instant petition<br \/>\nis allowed.
