Justice R.BASANT\n\n Dated :02\/05\/2008\n\n O R D E R\n                              R.BASANT, J\n                      ------------------------------------\n                     Crl.M.C.No.1787 of 2008\n                      -------------------------------------\n                Dated this the 2nd day of May, 2008\n\n                                  ORDER\n<\/pre>\n<p>     Petitioner faces indictment in a prosecution under Section<\/p>\n<p>138 of the Negotiable Instruments Act. Consequent to his non<\/p>\n<p>appearance, coercive processes have been issued against him by<\/p>\n<p>the learned Magistrate.         The petitioner apprehends arrest in<\/p>\n<p>execution of such processes.\n<\/p>\n<p>     2.    There is no representation for the petitioner.              The<\/p>\n<p>averments in the petition show that the petitioner is absolutely<\/p>\n<p>innocent. His absence earlier was not wilful or deliberate, it is<\/p>\n<p>averred. He is willing to surrender before the learned Magistrate<\/p>\n<p>and apply for bail. But he apprehends that his application for<\/p>\n<p>regular bail may not be considered by the learned Magistrate on<\/p>\n<p>merits, in accordance with law and expeditiously. It is therefore<\/p>\n<p>prayed that directions under Section 482 Cr.P.C may be issued in<\/p>\n<p>favour of the petitioner.\n<\/p>\n<p>     3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and    explain       to     the       learned   Magistrate the<\/p>\n<p>circumstances under which he could not earlier appear before the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1787 of 2008          2<\/span><\/p>\n<p>learned Magistrate. I have no reason to assume that the learned<\/p>\n<p>Magistrate would not consider such application on merits, in<\/p>\n<p>accordance with law and expeditiously. Every court must do the<\/p>\n<p>same. No special or specific direction appears to be necessary.<\/p>\n<p>Sufficient general directions have already been issued in <a href=\"\/doc\/147290035\/\">Alice<\/p>\n<p>George v. The Deputy Superintendent of Police<\/a> [2003(1)<\/p>\n<p>KLT 339].\n<\/p>\n<p>     4.
