JUSTICE SUSHIL HARKAULI\n                                         ------\n                For the Petitioner:      Mr. Sanjeev Kumar Mishra\n                For the Respondents:     Mr. Rajan Raj\n                                         ------\n04\/10.11.2009<\/pre>\n<p>          The petitioner does not appear to be serious about his offer.\n<\/p>\n<p>                He is just trying to adopt dilatory tactics by making illusory offers.\n<\/p>\n<p>                       Initially in January, 2006 the petitioner offered to pay the<br \/>\n                outstanding amount to the respondent bank in installments within<br \/>\n                12 months. If that offer has been accepted by the bank the<br \/>\n                payment would have been completed about two and half years<br \/>\n                ago. No payment was made by the petitioner. Thereafter, the<br \/>\n                petitioner came to this Court by means of present writ petition and<br \/>\n                after hearing the parties on 12.8.2009 i.e. almost three months<br \/>\n                ago, this Court directed by an interim order that if the petitioner<br \/>\n                deposits with the respondent bank a sum of Rs. 10 lakhs, which<br \/>\n                represents roughly half of the amount than due, the proceedings<br \/>\n                under &#8220;The Securitisation and Reconstruction of Financial Assets<br \/>\n                and Enforcement of Security Interest Act, 2002&#8221; against the<br \/>\n                petitioner will remain stayed. The petitioner did not deposit any<br \/>\n                worthwhile amount pursuant to that order and now the petitioner<br \/>\n                has approached this Court again saying that he is &#8220;prepared&#8221; to<br \/>\n                deposit the said amount of Rs. 10 lakhs through personal cheques,<br \/>\n                reliability of which would be very doubtful in view of the past<br \/>\n                conduct of the petitioner.\n<\/p>\n<p>                       But apart from reliability of these cheques, the more<br \/>\n                important fact is that because of non-deposit of the amount<br \/>\n                required by the interim order, proceedings under the Securitisation<br \/>\n                Act continued and the property has been sold to a third party for a<br \/>\n                sum of about Rs. 17 lakhs.\n<\/p>\n<p>                       In view of this development, the Court made an offer to the<br \/>\n                petitioner for deposit of a sum of Rs.15 lakhs within 10 days from<br \/>\n                today with the respondent bank, but the offer was declined by the<br \/>\n                learned counsel for the petitioner repeatedly. Now after this order<br \/>\n                has been dictated, learned counsel for the petitioner has consented<br \/>\n                to accept the offer again by issuing personal cheques.\n<\/p>\n<p><span class=\"hidden_text\">                                                 2.<\/span><\/p>\n<p>                    In the circumstances, I am of the opinion that the<br \/>\n            petitioner&#8217;s offer cannot be trusted. It is just meant to delay the<br \/>\n            proceedings.\n<\/p>\n<p>                   The interim order is vacated for non-compliance of the<br \/>\n            condition mentioned therein.\n<\/p>\n<p>                   The amount is due from the petitioner, who apparently does<br \/>\n            not intend to pay back even a part of it.\n<\/p>\n<p>                   In the circumstances, I am not inclined to exercise my<br \/>\n            discretionary and equitable writ jurisdiction in favour of the<br \/>\n            petitioner relying on technicalities.\n<\/p>\n<p>                   The writ petition is therefore dismissed.\n<\/p>\n<p>                                                               (Sushil Harkauli, J.)<br \/>\nSudhir\/FA\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Surendra Kumar Singh vs Uco Bank Thr Regional Manager on 10 November, 2009 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.
