N. Ravani, learned Standing Counsel appearing for the<br \/>\n\trespondent waives service of notice of rule in each of these two<br \/>\n\tapplications.\n<\/p>\n<p>OJCA<br \/>\n\tNo.524 of 2009 is filed by the applicant praying for extension of<br \/>\n\ttime to make the payment of balance amount of Rs.8 Lacs by a further<br \/>\n\tperiod of two months from the date of the said application which is<br \/>\n\tfiled on 24.12.2009.  The applicant has also prayed for stay against<br \/>\n\tthe operation and implementation of the demand notice dated<br \/>\n\t21.12.2009 issued by the respondent and seeking further direction<br \/>\n\tnot to take any coercive action pursuant to the demand notice dated<br \/>\n\t21.12.2009.\n<\/p>\n<p>OJCA<br \/>\n\tNo.8 of 2010 is filed praying for stay against the operation and<br \/>\n\timplementation of notice of attachment dated 08.01.2010 issued by<br \/>\n\tthe respondent and seeking further direction to the respondent not<br \/>\n\tto take any coercive action pursuant to notice of attachment dated<br \/>\n\t08.01.2010.\n<\/p>\n<p>Heard<br \/>\n\tMs. Samta Patel, learned advocate appearing for M\/s. Nanavati<br \/>\n\tAssociates for the applicant and Mr. Y.N. Ravani, learned Standing<br \/>\n\tCounsel appearing for the respondent.\n<\/p>\n<p>This<br \/>\n\tCourt has initially passed an order on 09.09.2009 whereby the notice<br \/>\n\twas issued in the Tax Appeal and pending admission of the appeal,<br \/>\n\torder was passed in Civil Application No.556 of 2009 directing the<br \/>\n\tapplicant to pay a sum of Rs.18 Lacs by 05.11.2009.  since the<br \/>\n\tapplicant could pay only Rs.10 Lacs, Civil Application No.524 of<br \/>\n\t2009 was filed seeking extension of time to pay the balance amount<br \/>\n\tof Rs.8 Lacs.  Since no order could be obtained by the applicant<br \/>\n\tduring the pendency of the said application, the respondent<br \/>\n\tauthority has issued notice of attachment on 08.01.2010 whereby the<br \/>\n\tapplicant was informed that as per Rule 5 of the Customs (Attachment<br \/>\n\tof Property of Defaulters for Recovery of Government Dues) Rules,<br \/>\n\t1995, delivery of the property attached or of any debt, dividend or<br \/>\n\tother moneys contrary to such attachment shall be held as void<br \/>\n\tagainst all claims enforceable under the attachment.  The applicant<br \/>\n\twas also prohibited from transferring the share or interest or<br \/>\n\tcreating charge in any way on the property under attachment.\n<\/p>\n<p>Ms.\n<\/p>\n<p>\tPatel, learned advocate appearing for the applicant has submitted<br \/>\n\tthat after filing of the application, the applicant has deposited<br \/>\n\tRs.5.50 Lacs and now, the amount remains to be paid as per the order<br \/>\n\tof this Court is only to the tune of Rs.2.50 Lacs which the<br \/>\n\tapplicant will deposit by 22.01.2010.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tY.N. Ravani, the learned Standing Counsel submitted that at present,<br \/>\n\tthe order of attachment is only to the effect that the applicant is<br \/>\n\trestrained from transferring, alienating and\/or creating any charge<br \/>\n\ton the property attached and there is no question of putting the<br \/>\n\tproperty on auction at this stage.  He has, therefore, submitted<br \/>\n\tthat on payment of the balance amount as directed by this Court<br \/>\n\tearlier, the property could not be sealed or sold till the next date<br \/>\n\tof hearing of the appeal and the impugned order of attachment is in<br \/>\n\tno way affects the interest of the applicant.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels appearing for the parties and having<br \/>\n\tconsidered their rival submissions, the Court hereby permits the<br \/>\n\tapplicant to make the payment of the balance amount of Rs.2.50 Lacs<br \/>\n\tso as to have the due compliance of the order, latest by 22.01.2010<br \/>\n\tand on payment of this amount, no further coercive measure will be<br \/>\n\ttaken by the respondent till the next date of hearing of the tax<br \/>\n\tappeal.  The notice of attachment dated 08.01.2010 which is sought<br \/>\n\tto be challenged in the present application dose not call for any<br \/>\n\tinterference.\n<\/p>\n<p>With<br \/>\n\tthis direction and observation, both the Civil Applications are<br \/>\n\taccordingly disposed of.\n<\/p>\n<p>Office<br \/>\n\tis directed to notify Tax Appeal No.1611 of 2009 for admission<br \/>\n\thearing on 04.02.2010.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[K.
