management would lead to; favourable ordeifsgfarid 'when;<\/p>\n
no such order came into eiiistence. Va..conciliation was

\ntherefore, there is not,_delay'V.in:_raising;_–,he dispute. In<\/p>\n

of fabricated and fictitious and<\/p>\n

responydelnjtr interalia contending that the reference of the<\/p>\n
 Induzstrfal dispute after 15 long years. without showing<\/p>\n
it 'trgsufficient cause was highly belated and suffered from<\/p>\n

3. Learned counsel for the petitioner advances the<\/p>\n
following contentions:\n<\/p>\n

Sufficient cause was not shown for the<\/p>\n
inordinate delay of 15 years in
\ndispute and therefore, the refe1*er1ce*aVb3i;  <\/p>\n
State Government was in \u00ab1je’spect”of_ a V ‘stale.<\/p>\n
claim suffering from   by <\/p>\n
that the Labour””t?Tot!.rt “fe’l’l._V_ii1a  not
\nrecording’     point’ of delay and
\nlatches   glea in the<\/p>\n

could not have led “eViderieei’ove.r_ <\/p>\n
oral assertion. it  ”\n<\/p>\n
(V) That the i-award.=ii11pt1\u00a7iie.d  arbitrary and<\/p>\n
illegal.\n<\/p>\n
4- Ptfit.    the respondent -~\nworkrnan    impugned as being\n<\/pre>\n
we11~rii_eri.ted;’d’~fi3_iI3′  and not calling for
\ninterfererice.    is contended that the order<\/p>\n
impesing the ” ‘–p1,1i1iS11InCI1t is contraiy to Regulation<\/p>\n
  Karnataka State Road Transport<\/p>\n
H 8: D) Regulations, 1971, since the<\/p>\n
 Disciplinavrv Authority, in exercise of discretion, did not<\/p>\n
it reeord reasons to dispense with the enquiry and<\/p>\n
it imposed the punishment. It is next contended that the<\/p>\n
trite<\/p>\n
failure on the part of the Appellate Authority in not<\/p>\n
disposing off the appeal, Exhibit W–3 preferred..VVag_:ai=hst<\/p>\n
the order of punishment, the respondent   <\/p>\n
initiated conciliation proeeedingsat theea1″liest”‘point.t_of <\/p>\n
time. Lastly it is contended that1’_’_th’ree’.st:i:dents.,,3i7ith<\/p>\n
passes, were aceommodate_d~\u00bb.__in the driVer”s_:”CaTt:in, to.’<\/p>\n
travel from Hagare to Hassanhonl’humanitarian ground,<\/p>\n
as the bus was full of    <\/p>\n
5.  ‘__.’Ere:ard   counsel for the
\n  examined the award
\nimpuvgnedi to the material on record,
\nthere  in the submission of the<\/p>\n
leaijned counsel: for the petitioner that the delay of 15<\/p>\n
\u00bb ;yeaIrs.:_in ‘rat-sing the dispute and referring the same for<\/p>\n
was not explained satisfactorily. In the<\/p>\n
Clainfstatement \ufb01led by the respondent, except for<\/p>\n
 stating that the papers were handed over to the<\/p>\n
v’;Seeretary of the Union who assured that the mtter<\/p>\n
would be taken up with the Management for discussion,<\/p>\n
in a bilateral forum, and that the Union was as.su.red by<\/p>\n
the Management that orders would be <\/p>\n
reconsideraton, and hence the ,..U\u00bbnion_-“vva*s:’_’vavvaiting ax? <\/p>\n
favourable order and further as nothing’.hap’pened,”l’the<\/p>\n
