R.C.KODEKAR, APP for\nRespondents \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tR.C.Kodekar, learned APP appears and waives service of notice of<br \/>\n\tRule on behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\t  applicant &#8211; convict prisoner, who,    vide    judgment<br \/>\n\tand  order dated 25.1.2006    rendered    in      Sessions   Case<br \/>\n\tNo. 13 of 2005      by     the     learned     Additional<br \/>\n\tSessions Judge,    Chhota   Udepur,  Vadodara,   has   been<br \/>\n\tconvicted for the offence punishable under Section 376 (2g) of the<br \/>\n\tIndian Penal Code and sentenced to RI for 10 years, has filed this<br \/>\n\tapplication through jail authority, praying to enlarge him on<br \/>\n\ttemporary bail for a period of 45 days to enable him to render<br \/>\n\tfinancial assistance to his family members who are starving. as<br \/>\n\tthere is no earning mail member in their family.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by  Mr.R.C.Kodekar, learned<br \/>\n\tAPP for the Respondent &#8211; State of Gujarat and perused the<br \/>\n\taverments made in the application. We have also gone through the<br \/>\n\tjail remark sheet submitted by the learned APP.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of 5 years, 10 months and 18 days of<br \/>\n\timprisonment and during the said period he has enjoyed temporary<br \/>\n\tbail on two occasions and has also enjoyed Furlough Leave on two<br \/>\n\toccasions and on all the occasions the Applicant &#8211; convict has<br \/>\n\tsurrendered in time.  Lastly he has enjoyed temporary bail and<br \/>\n\tfurlough leave in 2009 and thereafter he has not availed any<br \/>\n\ttemporary bail.  There is no jail punishment and the conduct of the<br \/>\n\tApplicant &#8211; convict in the jail is also good.  Besides this,<br \/>\n\tthe ground stated by the Applicant &#8211; convict prisoner seeking<br \/>\n\this release on temporary bail appears to be genuine.\n<\/p>\n<p>In<br \/>\n\tview of this, we deem it expedient to consider the plea of the<br \/>\n\tApplicant to release him on temporary bail for a period of 15 days<br \/>\n\tfrom the date of his actual release.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeed in part and and is<br \/>\n\taccordingly partly allowed.  The Applicant &#8211; Convict &#8211;<br \/>\n\tRAJUBHAI<br \/>\n\tGORDHANBHAI is ordered to be released on temporary<br \/>\n\tbail for a period of 15 days from the date of his actual release on<br \/>\n\texecuting a personal bond of Rs.5,000\/- before the jail authority on<br \/>\n\tusual terms and conditions. The applicant shall surrender to the<br \/>\n\tjail authority on completion of 15 days from the date of his release<br \/>\n\twithout fail.  During the period of temporary bail, the applicant<br \/>\n\tshall not abuse the liberty granted to him and shall maintain law<br \/>\n\tand order.
