PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     Leave granted<br \/>\n     Heard learned counsel on both sides.\n<\/p>\n<p>     The respondent  while in  service as Extra-Departmental<br \/>\nAgent  was   charge-sheeted,  for  misconduct  of  temporary<br \/>\nabsence from  duty,  under  Rule  8  of\t the  P\t &amp;  T  Extra<br \/>\nDepartmental Agents  (Conduct and  Services) Rules,  1964 on<br \/>\nJune 6,\t 1985. By order dated March 31,1986, the enquiry was<br \/>\ncancelled  and\t fresh\tenquiry\t was  conducted.  Later,  on<br \/>\nconclusion of the departmental enquiry proceedings, by order<br \/>\ndated July 9, 1990, the respondent was removed from service.<br \/>\nHe filed  an application in the Tribunal. By order dated May<br \/>\n28,   1992,   the   Tribunal   remitted\t  the\tmatter\t for<br \/>\nreconsideration on  the nature of punishment. That order was<br \/>\nunsuccessfully challenged  in  this  Court  and\t had  become<br \/>\nfinal. Subsequently,  when the\torder of  removal was passed<br \/>\nagain, it  was challenged  in the  Tribunal. The Tribunal by<br \/>\norder dated  September 4,  1993 quashed\t the proceedings and<br \/>\ndirected reconsideration of the quantum of punishment on the<br \/>\nbasis of  amended rules.  Again, it  was challenged  in\t the<br \/>\nspecial\t leave\t petition  before   this  Court\t  which\t was<br \/>\ndismissed. Consequently,  the respondent  was reinstated. He<br \/>\nagain filed  an application.  In the  impugned\torder  dated<br \/>\nDecember 5,  1995 made\tin O.A.\t No.787\/94, the Tribunal has<br \/>\ndirected payment  of  back-wages.  Thus,  these\t appeals  by<br \/>\nspecial leave.\n<\/p>\n<p>     This  Court   in\t<a href=\"\/doc\/1145593\/\">Rajasthan   State   Road   Transport<br \/>\nCorporation vs.\t Bhagyo Mal  &amp; Ors.<\/a>  [194 supp.(l)  SCC 573]<br \/>\nheld  that   while  the\t  High\tCourt  had  found  that\t the<br \/>\nrespondent-employee deserved  punishment on  account of\t his<br \/>\nmisconduct, and\t awarded lesser punishment, it is not liable<br \/>\nto grant  back-wages  particularly  when  the  Tribunal\t had<br \/>\nconverted the  order  of  dismissal  into  stoppage  of\t two<br \/>\nincrements with\t cumulative effect.  Therefore, the order of<br \/>\nthe High  Court was  set aside\tto that\t effect. It  is\t now<br \/>\nsettled law  that  imposition  of  punishment\t is  in\t the<br \/>\ndiscretion of  the disciplinary authority. But the authority<br \/>\nis expected  to exercise the discretion properly taking into<br \/>\nconsideration all  the relevant\t facts and circumstances. In<br \/>\nthis case,  the punishment  of removal\twas found  to be not<br \/>\njustified for the reason that the respondent was temporarily<br \/>\nabsent from  duty. But\tthe order  of dismissal\t having been<br \/>\nconverted into\tone of reinstatement with lesser punishment,<br \/>\nthe question  arises whether  the respondent  is entitled to<br \/>\nback-wages? The\t Tribunal was not right in directing payment<br \/>\nof back-wages  for the\treason that the respondent was found<br \/>\nto be  responsible for\tmisconduct though  lesser punishment<br \/>\nwas imposed.  Under these  circumstances and  following\t the<br \/>\nabove judgment,\t we hold that the respondent is not entitled<br \/>\nto back wages.\n<\/p>\n<p>     The appeals are accordingly allowed.
