Heard   Dr.    Anshuman,   learned<\/p>\n<p>                 counsel    for     the   petitioner,    Shri     Ajay<\/p>\n<p>                 Bihari Sinha, learned counsel appearing on<\/p>\n<p>                 behalf    of     respondent   nos.1    to   3\/Lalit<\/p>\n<p>                 Narayan Mithila University, Darbhanga and<\/p>\n<p>                 Shri Prabhu Narayan Sharma, learned A.C.<\/p>\n<p>                 to learned Advocate General, who appears<\/p>\n<p>                 on behalf of respondent no.4.\n<\/p>\n<p>                           The petitioner, who retired with<\/p>\n<p>                 effect from 31st July,2008 as Reader from<\/p>\n<p>                 R.B.S.     College       under   L.N.       Mithila<\/p>\n<p>                 University, has prayed for directing the<\/p>\n<p>                 respondents to pay post retiral dues and<\/p>\n<p>                 consequential      dues.   Learned     counsel   for<\/p>\n<p>                 the petitioner submits that most of the<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>retiral dues have already been paid, but<\/p>\n<p>he is still getting provisional pension.<\/p>\n<p>The   petitioner     has   categorically             stated<\/p>\n<p>his   claim    in    paragraph-9         of    the       writ<\/p>\n<p>petition, which is as follows :-<\/p>\n<blockquote><p>         (a)    Arrear of Salary towards 5th<\/p>\n<p>                Pay revision        =     Rs.9,63,618\/-<\/p>\n<\/blockquote>\n<blockquote><p>         (b)    Arrear of salary towards 6th<\/p>\n<p>                Pay Revision=           Rs.8,10,000\/-<\/p>\n<\/blockquote>\n<pre>         (c)    Leave          Encashment                  =\n\n                Rs.5,00,000\/-\n\n         (d)    Gratuity                Amount              =\n\n                Rs.10,00,000\/-\n\n         (e)    Deferred D.A.=          As per actual\n\n         (f)    Pension difference = As per\n\n                actual calculation\n\n         (g)    Fixation       of         pension         on\n\n                revised      scale        =         As   per\n\n                calculation.\n\n          Learned          counsel            for        the\n\npetitioner     submits     that     for       the    relief\n\n<\/pre>\n<blockquote><p>sought for in the present writ petition,<\/p>\n<p>petitioner has also filed representation<\/p>\n<p>before the authority concerned. However,<\/p>\n<p>till date, no decision has been taken nor<\/p>\n<p>aforesaid dues have been cleared.<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<\/blockquote>\n<p>With    the    consent            of    parties,         the    writ<\/p>\n<p>petition      is    being          disposed        of    granting<\/p>\n<p>liberty to the petitioner to file a fresh<\/p>\n<p>representation before respondent no.2\/Vice<\/p>\n<p>Chancellor,          L.N.             Mithila        University,<\/p>\n<p>Darbhanga      within         a       period of         six    weeks<\/p>\n<p>from     today.      If       such       representation           is<\/p>\n<p>filed,     respondent             no.2       is    required       to<\/p>\n<p>examine       the    same         and     pass       appropriate<\/p>\n<p>order    in    accordance               with      law    within    a<\/p>\n<p>period of four months from the date of<\/p>\n<p>filing of such representation. Respondent<\/p>\n<p>no.2 is further required to clear all the<\/p>\n<p>admitted      dues       of       the    petitioner           within<\/p>\n<p>aforesaid time. It is further directed to<\/p>\n<p>take decision for granting final pension<\/p>\n<p>to the petitioner within aforesaid time<\/p>\n<p>keeping in view the fact that petitioner<\/p>\n<p>retired in the year 2008 and still he is<\/p>\n<p>getting only provisional pension.
