NO. 676     OF 2007\n            ===========================\n\n     Dated this the 27th day of September,2007\n\n                     JUDGMENT\n<\/pre>\n<p>    Plaintiff  in  O.S.424\/1990  on  the  file   of<\/p>\n<p>Munsiff Court, Adoor is the appellant.   Defendants<\/p>\n<p>are the respondents.  Appellant instituted the suit<\/p>\n<p>seeking  a  decree  for  a  permanent   prohibitory<\/p>\n<p>injunction through her brother, on the strength of<\/p>\n<p>a power of attorney executed by plaintiff sister<\/p>\n<p>when she left the native place. Respondents raised<\/p>\n<p>a contention before the trial court that the power<\/p>\n<p>of  attorney  does  not  authorise  the  power   of<\/p>\n<p>attorney holder to institute the  suit and it only<\/p>\n<p>enables the power of attorney holder to execute<\/p>\n<p>document on behalf of his sister and therefore the<\/p>\n<p>suit is not maintainable.\n<\/p>\n<p>    2. Learned Munsiff accepted the objection and<\/p>\n<p>dismissed the suit as not maintainable.   Plaintiff<\/p>\n<p>through  the   power  of   attorney  holder   filed<\/p>\n<p>A.S.36\/2004 before District Court, Pathanamthitta.<\/p>\n<p><span class=\"hidden_text\">R.S.A.676\/07                 2<\/span><\/p>\n<p>The learned Additional District Judge on analysing<\/p>\n<p>Ext. A2 power of attorney held that it is a not a<\/p>\n<p>general power of attorney and        is only a special<\/p>\n<p>power of attorney and it does not authorise the<\/p>\n<p>power of attorney holder to institute the suit.<\/p>\n<p>Appeal was dismissed.        It is challenged in the<\/p>\n<p>second appeal contending that      Ext.A2 is a general<\/p>\n<p>power     of  attorney  and   therefore  the power   of<\/p>\n<p>attorney holder is entitled to institute the suit.<\/p>\n<p>      2.    Learned counsel appearing for appellant was<\/p>\n<p>heard.      Learned counsel made available a copy of<\/p>\n<p>Ext.A2.      On going through Ext.A2, it is absolutely<\/p>\n<p>clear      that  the  power  of  attorney  holder   was<\/p>\n<p>authorised     by  his  sister,     appellant only   to<\/p>\n<p>execute        document  on  her  behalf  and  not   to<\/p>\n<p>institute any suit. It is not a general power of<\/p>\n<p>attorney.     In  such  circumstance,   no  substantial<\/p>\n<p><span class=\"hidden_text\">R.S.A.676\/07                3<\/span><\/p>\n<p>question of law is involved in the appeal.        The<\/p>\n<p>appeal      is dismissed.
