GOVERNMENT PLEADER for Respondent(s) : 1, \nNone\nfor Respondent(s) : 2, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE D.A.MEHTA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MS.JUSTICE H.N.DEVANI)<\/p>\n<p>By<br \/>\n\tthis petition under Article 226 of the Constitution of India the<br \/>\n\tpetitioner challenges the demand note dated 8th<br \/>\n\tDecember, 2009 issued by the respondent No.2 Corporation demanding<br \/>\n\tpermission fee, administrative penalty and rent for the years<br \/>\n\t2007-08 to 2009-10 aggregating to Rs.1,20,000\/- on the Mobile Tower<br \/>\n\tof the petitioner Company.\n<\/p>\n<p>Ms.Viraj<br \/>\n\tFozdar, learned advocate appearing for the petitioner has invited<br \/>\n\tattention to the impugned demand note dated 8th<br \/>\n\tDecember, 2009 (Annexure  A ),<br \/>\n\tto point out that the same has been issued pursuant to amended<br \/>\n\tresolution No. NPL\/4508\/5427\/M dated 28th<br \/>\n\tNovember, 2009 issued by the Government of Gujarat, Urban<br \/>\n\tDevelopment and Urban Housing Department. It is submitted that the<br \/>\n\tsaid Government Resolution dated 28th<br \/>\n\tNovember, 2009 was subject matter of challenge before this Court in<br \/>\n\tSpecial Civil Application No.157 of 2010 and this Court vide order<br \/>\n\tdated 22nd<br \/>\n\tApril, 2010 has quashed the said resolution.\n<\/p>\n<p>Despite<br \/>\n\tservice of notice, there is no appearance on behalf of the<br \/>\n\trespondent No.2 &#8211; Corporation.   However, considering the fact that<br \/>\n\tthe controversy in issue stands concluded by the above referred<br \/>\n\tdecision of this Court, the matter is taken up for final hearing<br \/>\n\ttoday.\n<\/p>\n<p>As<br \/>\n\tnoted hereinabove, the controversy involved in the present petition<br \/>\n\tstands concluded vide judgment and order dated 22nd<br \/>\n\tApril, 2010 made in Special Civil Application No.157 of 2010 whereby<br \/>\n\tthe resolution No. NPL\/4508\/5427\/M dated 28th<br \/>\n\tNovember, 2009 issued by the Government of Gujarat, Urban<br \/>\n\tDevelopment and Urban Housing Department has been quashed and set<br \/>\n\taside. In the said case, this Court has followed its decision in the<br \/>\n\tcase of <a href=\"\/doc\/63840779\/\">Indus<br \/>\n\tTowers Ltd. v. State of Gujarat and others<\/a>,<br \/>\n\trendered on 22nd<br \/>\n\tApril, 2010 in Special Civil Application No.1898 of 2009 and other<br \/>\n\tcognate matters, whereby the Resolution dated 11th<br \/>\n\tDecember, 2008 issued by<br \/>\n\tthe Government of Gujarat, Urban Development and Urban Housing<br \/>\n\tDepartment, providing<br \/>\n\tfor levy and recovery of Annual Permission Fees and Installation<br \/>\n\tCharges on mobile telecommunication towers in the areas covered<br \/>\n\tunder Municipal Corporations\/Municipalities in the State of Gujarat<br \/>\n\thas been struck down as being ultra vires the provisions of Article<br \/>\n\t265 of the Constitution of India as well as ultra vires the<br \/>\n\tprovisions  of the Bombay Provincial Municipal Corporation Act, 1949<br \/>\n\tand the Gujarat Municipalities Act, 1963.\n<\/p>\n<p>In<br \/>\n\tthe circumstances, in the light of the order dated 22nd<br \/>\n\tApril, 2010 made in Special Civil Application No.157 of 2010, when<br \/>\n\tthe Government Resolution which forms the basis of the demand in the<br \/>\n\tpresent case has been set aside, the demand cannot be sustained.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons the petition succeeds and is accordingly<br \/>\n\tallowed.
