Pragasam and Ms. Kamini Jaiswal, Advs. with him for the<br \/>\nappearing parties.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\nThe following Order of the Court was delivered:\n<\/p>\n<blockquote><p>\t\t\t    WITH<br \/>\n\t    WRIT PETITION (CRL) no. 592 OF 1987<br \/>\n\t\t\t O R D E R<br \/>\n     On December  18, 1996 in D.K. Basu Versus State of West<br \/>\nBengal (1997  (1) SCC  416), this  court laid  down  certain<br \/>\nbasic &#8220;requirements&#8221;  to be  followed in all cases of arrest<br \/>\nor detention  till legal  provisions are made in that behalf<br \/>\nas  a\tmeasure\t to   prevent  custodial   violence.\t The<br \/>\nrequirements read as follows.\n<\/p><\/blockquote>\n<blockquote><p>     &#8220;1.  The police  personnel carrying<br \/>\n     out the  arrest  and  handling  the<br \/>\n     interrogation   of\t  the\tarrestee<br \/>\n     should bear  accurate, visible  and<br \/>\n     clear identification and name clear<br \/>\n     identification and\t name tags  with<br \/>\n     their    designations.\t     The<br \/>\n     particulars  of   all  such  police<br \/>\n     personnel who  handle interrogation<br \/>\n     of the arrestee must be recorded in<br \/>\n     a register.\n<\/p><\/blockquote>\n<blockquote><p>     2.\t  That\t the\tpolice\t officer<br \/>\n     carrying  out  the\t arrest\t of  the<br \/>\n     arrestee shall  prepare a\tmemo  of<br \/>\n     arrest at\tthe time  of arrest  and<br \/>\n     such memo\tshall be  attested by at<br \/>\n     least one\twitness, who  may either<br \/>\n     be a  member of  the family  of the<br \/>\n     arrestee or a respectable person of<br \/>\n     the locality  from where the arrest<br \/>\n     is\t made.\t   It\tshall  also   be<br \/>\n     countersigned by  the arrestee  and<br \/>\n     shall contain  the time and date of<br \/>\n     arrest.\n<\/p><\/blockquote>\n<blockquote><p>     3.\t  A person who has been arrested<br \/>\n     or detained  and is  being held  in<br \/>\n     custody  in  a  police  station  or<br \/>\n     interrogation centre or other lock-<br \/>\n     up, shall\tbe entitled  to have one<br \/>\n     friend or\trelative or other person<br \/>\n     know to  him or  having interest in<br \/>\n     his welfare being informed, as soon<br \/>\n     as practicable,  that he  has  been<br \/>\n     arrested and  is being  detained at<br \/>\n     the particular  place,  unless  the<br \/>\n     attesting witness\tof the\tmemo  of<br \/>\n     arrest is\thimself such a friend or<br \/>\n     a relative of the arrestee.\n<\/p><\/blockquote>\n<blockquote><p>     4.\t  The time,  place of arrest and<br \/>\n     venue of  custody\tof  an\tarrestee<br \/>\n     must  be  notified\t by  the  police<br \/>\n     where the\tnext friend  or relative<br \/>\n     of the  arrestee lives  outside the<br \/>\n     district or  town through the Legal<br \/>\n     Aid Organisation  in  the\tDistrict<br \/>\n     and the  police station of the area<br \/>\n     concerned telegraphically\twithin a<br \/>\n     period of\t8 to  12 hours after the<br \/>\n     arrest.\n<\/p><\/blockquote>\n<blockquote><p>     5.\t  The person  arrested\tmust  be<br \/>\n     made aware\t of this  right to  have<br \/>\n     someone informed  of his  arrest or<br \/>\n     detention as  soon\t as  he\t is  put<br \/>\n     under arrest or is detained.\n<\/p><\/blockquote>\n<blockquote><p>     6.\t  An entry  must be  made in the<br \/>\n     diary at  the  place  of  detention<br \/>\n     regarding the  arrest of the person<br \/>\n     which shall  also disclose the name<br \/>\n     of the next fried of the person who<br \/>\n     has been informed of the arrest and<br \/>\n     the names\tand particulars\t of  the<br \/>\n     police officials  in whose\t custody<br \/>\n     the arrestee is.\n<\/p><\/blockquote>\n<blockquote><p>     7.\t  The arrestee\tshould, where he<br \/>\n     so requests,  be also  examined  at<br \/>\n     the time  of his  arrest and  major<br \/>\n     and minor\tinjuries, if any present<br \/>\n     on his\/her\t body, must  be recorded<br \/>\n     at\t that  time.\tThe  &#8220;Inspection<br \/>\n     Memo&#8221; must\t be signed  both by  the<br \/>\n     arrestee  and  the\t police\t officer<br \/>\n     effecting the  arrest and\tits copy<br \/>\n     provided to  the arrestee\tand  the<br \/>\n     police officer effecting the arrest<br \/>\n     and  its\tcopy  provided\t to  the<br \/>\n     arrestee.\n<\/p><\/blockquote>\n<blockquote><p>     8.\t  The\tarrestee    should    be<br \/>\n     subjected to medical examination by<br \/>\n     a trained\tdoctor\tevery  48  hours<br \/>\n     during his\t detention in custody by<br \/>\n     a doctor  on the  panel of approved<br \/>\n     doctors  appointed\t  by   Director,<br \/>\n     Health Services  of  the  State  or<br \/>\n     Union     Territory      concerned.<br \/>\n     Director,\tHealth\tServices  should<br \/>\n     prepare  such   a\tpenal\tfor  all<br \/>\n     tehsils and districts as well.\n<\/p><\/blockquote>\n<blockquote><p>     9.\t  Copies of  all  the  documents<br \/>\n     including\tthe   memo  of\t arrest,<br \/>\n     referred to  above, should\t be sent<br \/>\n     to the  Illega Magistrate\tfor  his<br \/>\n     record.\n<\/p><\/blockquote>\n<blockquote><p>     10.  The arrestee\tmay be permitted<br \/>\n     to\t  meet\t  his\tlawyer\t  during<br \/>\n     interrogation,\t though\t     not<br \/>\n     throughout the interrogation.\n<\/p><\/blockquote>\n<blockquote><p>     11.  A police control room could be<br \/>\n     provided at  all district and State<br \/>\n     headquarters,   where   information<br \/>\n     regarding the  arrest and the place<br \/>\n     of custody of the arrestee shall be<br \/>\n     communicated by the officer causing<br \/>\n     the  arrest,  within  12  hours  of<br \/>\n     effecting the  arrest  and\t at  the<br \/>\n     police control  room it  should  be<br \/>\n     displayed on  a conspicuous  notice<br \/>\n     board.&#8221;<\/p><\/blockquote>\n<blockquote><p>     This court\t also opined that failure to comply with the<br \/>\nabove  requirements,   apart  from  rendering  the  official<br \/>\nconcerned liable  for departmental action, would also render<br \/>\nhim liable  to be  punished for\t contempt of  court and\t the<br \/>\nproceedings for contempt of court could be instituted in any<br \/>\nHigh Court  of country, having territorial jurisdiction over<br \/>\nthe matter.  This Court further observed :\n<\/p><\/blockquote>\n<blockquote><p>     &#8220;The requirements\tmentioned  above<br \/>\n     shall be  forwarded to the Director<br \/>\n     General   of    every   State\/Union<br \/>\n     Territory and  it\tshall  be  their<br \/>\n     obligation to circulate the same to<br \/>\n     every police  station  under  their<br \/>\n     charge and get the same notified at<br \/>\n     every police  station  under  their<br \/>\n     charge and get the same notified at<br \/>\n     every   police    station\t at    a<br \/>\n     conspicuous place.\t  It  would also<br \/>\n     be useful and serve larger interest<br \/>\n     to broadcast  the\trequirements  on<br \/>\n     All India Radio besides being shown<br \/>\n     on\t  the\t national   Network   of<br \/>\n     Doordarshan any  by publishing  and<br \/>\n     distributing pamphlets in the local<br \/>\n     language\t   containing\t   these<br \/>\n     requirements for information of the<br \/>\n     general public.  Creating awareness<br \/>\n     about the\tlights of  the\tarrestee<br \/>\n     would in  our opinion  be a step in<br \/>\n     the right\tdirection to  combat the<br \/>\n     evil of  custodial crime  and bring<br \/>\n     in transparency and accountability.<br \/>\n     It is hoped and accountability.  It<br \/>\n     is\t hoped\tthat  thee  requirements<br \/>\n     would help\t to curb, if not totally<br \/>\n     eliminate,\t   the\t  use\t of    a<br \/>\n     questionable     methods\t  during<br \/>\n     interrogation   and   investigation<br \/>\n     leading to\t custodial commission of<br \/>\n     crimes.&#8221;<\/p><\/blockquote>\n<blockquote><p>     More  than\t  seven\t months\t  have\telapsed\t  since\t the<br \/>\ndirections  were  issued.    Through  these  petitions,\t Dr.<br \/>\nSinghvi, the  learned Amicus  Curiae, who  had assisted\t the<br \/>\nCourt in  the main petition, seeks a direction, calling upon<br \/>\nthe Director  General of  Police and  the Home\tSecretary of<br \/>\nevery  State\/union   Territory\tto   report  to\t  this\tCurt<br \/>\ncompliance of  the above  directions and  the steps taken by<br \/>\nthe All\t India Radio and the National Network of Doordarshan<br \/>\nfor broadcasting the requirements.<\/p>\n<p>     We\t direct\t  the  Registry\t to  send  a  copy  of\tthis<br \/>\napplication,  together\t with  a   copy\t of  this  order  to<br \/>\nrespondents 1  to 31  to have  the report\/reports  from\t the<br \/>\nDirector General  of Police  and the  Home Secretary  of the<br \/>\nconcerned  State\/Union\t Territory,  sent   to\tthis   Court<br \/>\nregarding the  compliance of the above directions concerning<br \/>\narrestees.  The report shall indicate in a tabular from a to<br \/>\nwhich of the &#8220;requirements&#8221; has been carried out and in what<br \/>\nmanner, as  also which\tare the\t &#8220;requirements&#8221; which  still<br \/>\nremain to  be carried  out and\tthe steps  being  taken\t for<br \/>\ncarrying out those.\n<\/p>\n<p>     Report shall also be obtained from the Directors of All<br \/>\nIndia Radio and Doordarshan regarding broadcasts made.\n<\/p>\n<p>     The notice\t on respondents\t 1 to  31, in  addition, may<br \/>\nalso  be   served  through   the  standing  counsel  of\t the<br \/>\nrespective State\/union\tTerritories in\tthe  Supreme  Court.<br \/>\nAfter the  reports are received, copies of the same shall be<br \/>\nfurnished to  the Advocate  on Record  for Dr.\tSinghvi, Ms.<br \/>\nSuruchi Agarwal, Advocate.\n<\/p>\n<p>     The reports  shall be  submitted to  this court  in the<br \/>\nterms, indicated  above, within\t six weeks  from today.\t The<br \/>\nmatters shall be put up on board for monitoring, after seven<br \/>\nweeks.\n<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Shri Dilip K.
