Whether the judgment should be reported in the Digest?\n\n\nPresent:     Mr.Parminder Singh, Advocate,\n             for the petitioner.\n\n                         *****\n\nRANJIT SINGH, J.\n<\/pre>\n<p>             The petitioner was appointed as Steno on 1.3.1977 and<br \/>\nwas promoted as Assistant in the year 2002. He was promoted as<br \/>\nExcise Inspector on 11.1.2007. As per the condition of service, the<br \/>\npetitioner was required to pass a departmental examination. The<br \/>\ncondition of granting exemption from appearing in the departmental<br \/>\nexamination has been done away. The petitioner could not qualify in<br \/>\nthe departmental examination and accordingly has been reverted.\n<\/p>\n<p>             Counsel for the petitioner submits that petitioner had filed<br \/>\na representation for availing mercy chance to appear in the<br \/>\nexamination of left over subject on 3.8.2010. That representation is<br \/>\nstill pending and during that period, he was served a show cause<br \/>\nnotice on 4.8.2011 and has now been reverted vide order dated<br \/>\n30.6.2011.\n<\/p>\n<p>             Counsel says that the petitioner had sought opportunity of<br \/>\npersonal hearing, which, he could not avail because of being in the<br \/>\nhospital. The petitioner accordingly has filed this writ petition.\n<\/p>\n<p><span class=\"hidden_text\"> Civil Writ Petition No.14529 of 2011                 :2:<\/span><\/p>\n<p>             Once the petitioner has not complied with the condition of<br \/>\nservice, the reversion order will not suffer from any arbitrariness or<br \/>\nillegality. To grant or not grant mercy chance would be a discretion<br \/>\nof the respondents. The court will hardly have any jurisdiction to<br \/>\ninterfere in such like matters.\n<\/p>\n<p>             No merit in the writ petition.
