BASANT, J.\n                 - - - - - - - - - - - - - - - - - - - - - -\n                    B.A.No. 6654 of 2007\n                 - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 16th day of November, 2007\n\n                              O R D E R\n<\/pre>\n<p>      Application for anticipatory bail.             The petitioner faces<\/p>\n<p>allegations in a crime registered for offences punishable under<\/p>\n<p>Sections 420 and 406 I.P.C.\n<\/p>\n<p>      2. The crux of the allegations against the petitioner is that<\/p>\n<p>he had fraudulently dealt with a vehicle which was handed over<\/p>\n<p>to him by the defacto complainant on the basis of an agreement<\/p>\n<p>for sale. The vehicle was not traceable. It is apprehended that<\/p>\n<p>the vehicle has been         dismantled and disposed of by the<\/p>\n<p>petitioner. Crime has been registered on the basis of a private<\/p>\n<p>complaint filed by the defacto complainant before the learned<\/p>\n<p>Magistrate and referred to the police under Section 156(3)<\/p>\n<p>Cr.P.C. Investigation is in progress. The petitioner apprehends<\/p>\n<p>imminent arrest.\n<\/p>\n<p>      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent of the allegations levelled<\/p>\n<p>B.A.No. 6654 of 2007<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>against him. He is only a vehicle broker. He does not purchase the<\/p>\n<p>vehicles in his name. He only brokers the deal between individuals. In<\/p>\n<p>these circumstances the petitioner does not deserve to endure the<\/p>\n<p>trauma of arrest, if any of the parties to such a deal brokered by him<\/p>\n<p>had committed any culpable act.          The petitioner may, in these<\/p>\n<p>circumstances be granted anticipatory bail, prays the learned counsel.<\/p>\n<p>      3.   The learned Prosecutor opposes the application. The case<\/p>\n<p>diary was placed before me for my perusal. I have perused the same.<\/p>\n<p>The learned Prosecutor points out that the document seized by the<\/p>\n<p>police in this case does clearly show that the petitioner was not a mere<\/p>\n<p>broker and was the one who had purchased the vehicle from the<\/p>\n<p>defacto complainant. The petitioner has to be thoroughly interrogated.<\/p>\n<p>The vehicle which has been clandestinely disposed of has to be traced.<\/p>\n<p>In these circumstances the petitioner may not be permitted to arm<\/p>\n<p>himself with an order of anticipatory bail, submits the Prosecutor. He<\/p>\n<p>points out that the petitioner has been absconding for a long period of<\/p>\n<p>time.   The crime was registered as early as on 17.8.2006, but the<\/p>\n<p>petitioner was not available for apprehension.<\/p>\n<p>B.A.No. 6654 of 2007<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>      4. Having considered all the relevant inputs, I find merit in the<\/p>\n<p>opposition by the learned Prosecutor.     I am unable to perceive any<\/p>\n<p>features in this case, which would justify the invocation of the extra<\/p>\n<p>ordinary equitable discretion under section 438 Cr.P.C. in favour of the<\/p>\n<p>petitioner.  This, I agree with the learned Prosecutor, is a fit case<\/p>\n<p>where the petitioner must be directed to appear before the Investigator<\/p>\n<p>or the learned Magistrate having jurisdiction and then seek regular bail<\/p>\n<p>in the ordinary course.\n<\/p>\n<p>            5. This application is accordingly dismissed.        I may<\/p>\n<p>however hasten to observe that if the petitioner appears before the<\/p>\n<p>learned Magistrate and applies for bail after giving sufficient prior<\/p>\n<p>notice to   the   Prosecutor   in charge of the case,     the  learned<\/p>\n<p>Magistrate must proceed to pass orders on merits, in accordance with<\/p>\n<p>law and expeditiously.\n<\/p>\n<\/p>\n<p>                                             (R.
