KRISHNAN, J.\n                        -------------------------------\n                    R.P.F.C.No.178 OF 2005\n                    ---------------------------------------\n             Dated this the 24th day of February, 2010\n\n                                O R D E R\n<\/pre>\n<p>     This revision is preferred against the order of the Family<\/p>\n<p>court, Ernakulam in M.C.356\/01. The family court rejected the<\/p>\n<p>request for maintenance by the petitioner on the ground that the<\/p>\n<p>marriage is not proved and the maintenance petitioner had failed<\/p>\n<p>to prove that she is the wife of the respondent therein. It is<\/p>\n<p>against that decision the revision is preferred by the wife. I feel<\/p>\n<p>a reference to the maintenance petition itself will go against the<\/p>\n<p>case. It is specifically avered that there was a marriage between<\/p>\n<p>the revision petitioner and the respondent on 27.5.1973 as per<\/p>\n<p>Hindu custom and practice. It is also specifically avered that<\/p>\n<p>there was a marriage Udampady between the two on the<\/p>\n<p>previous day of the marriage. Again in para 5 it is avered that<\/p>\n<p>after a week of the marriage, the respondent left the residence of<\/p>\n<p>the petitioner without any reason. So in order to sustain the<\/p>\n<p>case it is become incumbent upon the revision petitioner to<\/p>\n<p>prove the marriage. The document that is proved in this case at<\/p>\n<p>the most is the marriage Udampady                alleged to be executed on<\/p>\n<p>26.5.1973.   It has to be remembered that revision petitioner<\/p>\n<p>claims the status of the wife not on the basis of the Udampady<\/p>\n<p>but on the basis of the marriage alleged to have been taken<\/p>\n<p>place on 27.5.1973.      Absolutely no    acceptable evidence is<\/p>\n<p>tendered before the court to prove the same. A photograph<\/p>\n<p>without proving the same cannot be looked into as evidence and<\/p>\n<p>the decree of the court rejecting the prayer of the respondent to<\/p>\n<p>declare the marriage Udampady as invalid also will not help the<\/p>\n<p>petitioner to prove that she is the wife of the respondent. If a<\/p>\n<p>man or woman lives for so long number of years under the<\/p>\n<p>same roof then law recognises them as husband and wife. In this<\/p>\n<p>case before us it is specifically pleaded in the petition itself, the<\/p>\n<p>so called husband left the house immediately after the marriage.<\/p>\n<p>So it has to be stated that there is no evidence regarding the<\/p>\n<p>marriage. There is no evidence regarding the cohabitation and<\/p>\n<p>when it is so, the court would not interfere with the order of the<\/p>\n<p>family court holding that the revision        petitioner had not<\/p>\n<p>succeeded in proving the marriage. Therefore, the revision lacks<\/p>\n<p>merits and hence dismissed.\n<\/p>\n<\/p>\n<p>                                       M.N.
