 claimants are the wife and minor children of the<\/p>\n
Vlif-~.d,eceavsed Venkatesh. The deceased Venkatesh was working as<\/p>\n

a driver in the iorry bearing Registration No.KA–19~H-527, whgich<\/p>\n
belongs to Respondent No.1. He was receiving a_..S_\u00e9ia’ryf’~.of~V.<\/p>\n
Rs.4,500\/– per month and bata of Rs.100\/- per  <\/p>\n
19.5.2004 at about 1.00 p.rn. when the cie\u00a2ieaseave..nretestwag.<\/p>\n
driving the lorry with a ‘load _.of e\u00e9ucgaiyptus.:_trees’~ <\/p>\n
Kenchanakuppe towards Neiiigudde.HiV:n”*.front’of”Chandramiand,
\nthe lorry proceeded on the   tuurtgied and fell into a
\nditch. The said Venkatesh sustained”grievous;_~i.nj’_uries and died<\/p>\n
on the way to the ho’s’p’i\u00abtai’.\n<\/p>\n

assessed the wages of the deceased at Rs.3,500\/– per-V’.<\/p>\n
and adopting the relevant factor of 169.44 since  <\/p>\n
deceased was 45 years, has awardeidla ._comp\u00abe.ns’a_tion~7=of”:<\/p>\n
Rs.2,96,520\/– (Rs.1,75O x 169.44) with’v__interest>.g’;:t”12~%\u00bb.4″pe’r”~.<\/p>\n
annum from one month from the dat’e..of.acciden_t.’~~..  A<\/p>\n
8. Feeling aggrieved bvlthle\ufb01iegal heirs of the
\ndeceased Venkatesh have prefe’rre:(:i  <\/p>\n

   perused the impugned order. The main grievance<\/p>\n
vthe_.5learned counsel for the appeilants is that eventhough<\/p>\n
lll”–\u00abu.AVdeceased Venkatesh wasa driver during the year 2004, the<\/p>\n

assessed the income of the deceased at Rs.3,500\/– per~4jru1.o_htre,’4<\/p>\n
which is on the iower side. Normaily this Court takes ‘<\/p>\n
of the driver at Rs.-4,000\/– per month. V.~~Ev.en  C”<\/p>\n
Wages Act, the minimum wages that <\/p>\n
Government is Rs.2,690\/– as on 2O>Od_:’.’2.faking.irrto:c.on’sid’era’tion ” it<\/p>\n
that the deceased was a driver of’V.ih’ea’vy”g-.o_ods Avehiciei, in my
\nview, the wages of the deceaisedicany  at Rs.4,000\/-
\nper month instead   the deceased at<\/p>\n

the Commissioner for Wori<men's Confipensation is Ventra'nged~\u00ab<\/p>\n
to Rs.3,38,880\/–.\n<\/p>\n
3. The appellants\/claimants are entit.le”d\u00bb for”interes_”t ”’i\/\u00a7 % it<\/p>\n
