No.295.11\n\n\n           Review Petition No. 295 of 2011\n22\/07\/2011\n     Shri Sanjay Dwivedi, learned counsel for the\npetitioner.\n     Though many a ground has been raised for\nseeking    review    of   the   order   dated   05-05-2011\npassed in Writ Petition No. 15970\/10; however,\nlearned counsel for the petitioner as confined to\nthe submission that, inadvertently his presence is\nnot marked in the order dated 05-05- 2011           as also\nthe fact of filing of return on behalf of respondent<\/pre>\n<p>No. 1.\n<\/p>\n<p>     It is observed that though the return in writ<br \/>\npetition was filed on 05-04-2011, the office had<br \/>\nnot placed the same on record. In the return filed<br \/>\nby respondent No. 1 a justification was tendered<br \/>\nas to action taken against the petitioner that, the<br \/>\ntransfer      of   the    petitioner    was     purely      on<br \/>\nadministrative ground taking note of the fact that<br \/>\nhe was found involved in financial irregularities<br \/>\nand was facing enquiry for the same.\n<\/p>\n<p>     However, keeping in view the nature of the<br \/>\norder which was passed on 05-05- 2011 on the anvil<br \/>\nof the fact that transfer was stayed by an order<br \/>\ndated 12-11-2010 and that the respondents were<br \/>\ngranted liberty to pass a fresh order in case of<br \/>\n                                                               R.P. No.295.11<\/p>\n<p>administrative exigency so warrants, this Court is<br \/>\nof the considered opinion that the order dated<br \/>\n05- 05-2011 does not warrant any reconsideration<br \/>\neven when the stand taken in the return is taken<br \/>\ninto consideration.\n<\/p>\n<p>      In    respect     of        submission     of    the     learned<br \/>\ncounsel for the petitioner that his appearance on<br \/>\nbehalf of respondent No. 1 in Writ Petition No.<br \/>\n15970\/10 be noted, it is observed that the said<br \/>\ninadvertent error which had crept in the order<br \/>\ndated      05-05-2011        is    rectified    and     the    learned<br \/>\ncounsel is treated to have appeared for respondent<br \/>\nNo. 1.\n<\/p>\n<p>      The review petition is finally disposed of in<br \/>\nabove terms.\n<\/p>\n<p>      Let a copy of this order be placed on record<br \/>\nof   Writ    Petition      No.      15970\/10          and     office      is<br \/>\ndirected     to   supply      the    certified    copy        of   order<br \/>\ndated      05-05-2011        passed     in     Writ    Petition        No.<br \/>\n15970\/10 along with the certified copy of this<br \/>\norder passed today in Review Petition No. 295 of<br \/>\n2011.<\/p>\n<pre>\n\n\n\n\n                                          (SANJAY YADAV)\nSC                                            JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Bharat Scout And Guide vs Shriram Saini on 22 July, 2011 R.P.
