THAKER   14th October, 2008\n\t\t\n\t\n\n \n\n ORAL\nORDER<\/pre>\n<p> (Per<br \/>\n: HONOURABLE MS. JUSTICE R.M. DOSHIT)<\/p>\n<p>\t  This<br \/>\nAppeal preferred under clause 15 of the Letters Patent arises from<br \/>\nthe order dated 28th April, 2006 made by the learned<br \/>\nSingle Judge in above Civil Application No. 7560 of 2003.\n<\/p>\n<p>\t  The<br \/>\napplicant made above Civil Application No. 7560 of 2003 for leave to<br \/>\nappeal against the judgment and order dated 30th July,<br \/>\n2003 passed by the learned City Civil Judge in Civil Suit No. 5934 of<br \/>\n1996. According to the applicant, the decree passed in Civil Suit No.<br \/>\n5934 of 1996 adversely affects his right, title and interest in suit<br \/>\nShop No. 225, situated at Kamdhenu A.C Market, Panchkuva, Ahmedabad.<br \/>\nThe appellant, therefore, be permitted to file appeal against the<br \/>\nsaid judgment.\n<\/p>\n<p>\t   The<br \/>\napplication was contested by the respondent no.1-the plaintiff<br \/>\nin the suit. According to the respondent no.1, the suit shop no. 225<br \/>\nis in possession of the respondent no.1. The interest claimed by the<br \/>\napplicant is sham and bogus. The applicant is acting in collusion<br \/>\nwith the respondent no.2-the defendant. The learned Single Judge has<br \/>\ndismissed the application. According to the learned Single Judge, if<br \/>\nthe applicant had any interest in the suit-shop no. 225, he would not<br \/>\nhave set quiet for such a long time and would have initiated action<br \/>\nagainst the respondent no.1, plaintiff for trespass. Therefore, the<br \/>\npresent Appeal.\n<\/p>\n<p>\t  Mr.\n<\/p>\n<p>Shelat has relied upon the impugned judgment passed by the<br \/>\nlearned City Civil Judge to point out that the title and possession<br \/>\nof the shop no. 225 is at stake. To prove his possession and<br \/>\ninterest, he has relied upon the possession agreement allegedly<br \/>\nexecuted on 21st October, 1996.\n<\/p>\n<p>\t    Mr.\n<\/p>\n<p>Nanavati has appeared for the respondent no. 1 and has  contested the<br \/>\nAppeal. He has questioned the genuineness of the aforesaid possession<br \/>\nagreement dated 21st October, 1996. He has submitted that<br \/>\nin the suit, the respondent no.2-defendant had produced an agreement<br \/>\nfor sale executed in the year 2001. This itself proves collusion<br \/>\nbetween the applicant and the respondent no.2.\n<\/p>\n<p>\t   We<br \/>\nhave considered the rival contentions raised before us. It is<br \/>\nindisputable  that the title and possession of suit shop no. 225 is<br \/>\nat stake. Prima facie, the applicant has shown his<br \/>\nright\/interest in the suit shop no. 225. Whether the claim made by<br \/>\nthe applicant is genuine or not can be decided in a substantive<br \/>\nproceeding and not in the present Application.\n<\/p>\n<p>\t  For<br \/>\nthe aforesaid reason, the Appeal is allowed. The impugned<br \/>\norder dated 28th April, 2006 made by the learned Single<br \/>\nJudge is quashed and set-aside. Civil Application No. 7560 of<br \/>\n2003 for leave to appeal filed by the appellant is allowed.
