Justice K.HEMA\n\n Dated :21\/05\/2010\n\n O R D E R\n                             K.HEMA, J.\n                          ------------------\n                      B.A. No. 2219 of 2010\n                     -----------------------------\n               Dated this the 21st day of May, 2010\n\n\n                             O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.<\/p>\n<p>     2.    The alleged offence is under Section 498 A read with<\/p>\n<p>Section 34 of the Indian Penal Code. According to prosecution,<\/p>\n<p>de facto complainant was physically and mentally harassed by<\/p>\n<p>the petitioners, who are her husband and farther in law.<\/p>\n<p>     3. Learned counsel for petitioners submitted that petitioners<\/p>\n<p>have not committed any offence, but false complaint is filed.<\/p>\n<p>     4. Learned Public Prosecutor submitted that there are<\/p>\n<p>allegations against her husband, first accused which will<\/p>\n<p>constitute offence under Section 498 A of the Indian Penal Code<\/p>\n<p>but so far as the second accused is concerned, this petition is not<\/p>\n<p>opposed.\n<\/p>\n<p>     5. On hearing both sides I think that this is not a fit case to<\/p>\n<p>grant anticipatory bail to the first accused, but bail can be allowed<\/p>\n<p>in favour of second accused.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 2219 of 2010               2<\/span><\/p>\n<p>      6. Hence the following order is passed.<\/p>\n<p>          1. Prayer for anticipatory bail by the first accused<\/p>\n<p>              is rejected.\n<\/p>\n<p>           2. Second accused shall surrender before the<\/p>\n<p>              Magistrate Court concerned within 7 days<\/p>\n<p>              from today and he shall be released on bail on<\/p>\n<p>              his executing a bond for Rs. 25,000\/- with<\/p>\n<p>              two solvent sureties each for the like sum to<\/p>\n<p>              the satisfaction of the Magistrate Court on the<\/p>\n<p>              following conditions:\n<\/p>\n<p>                 i) He shall not influence or intimidate<br \/>\n                    the witnesses or tamper with the<br \/>\n                    evidence.\n<\/p>\n<p>                 ii) He   shall   co-operate   with    the<br \/>\n                    investigation   and   report   before<br \/>\n                    investigating officer as and when<br \/>\n                    directed.\n<\/p>\n<p>       This petition is partly allowed.<\/p>\n<p>                                        K.
