Justice P.S.GOPINATHAN\n\n Dated :15\/05\/2009\n\n O R D E R\n                        P.S.GOPINATHAN, J.\n           ======================================\n                       B.A.No. 1777 of 2009\n            ======================================\n                Dated this the 15th day of May 2009\n\n                              ORDER\n<\/pre>\n<p>      The petitioners are accused in Crime No.104 of 2009 of<\/p>\n<p>Vadakkekkad Police Station for the offences punishable under<\/p>\n<p>Sections 143, 147, 341, 324, 308 and 427 read with Section<\/p>\n<p>149 IPC.    Apprehending arrest, detention and torture at the<\/p>\n<p>hands of the investigating officer, they moved a petition under<\/p>\n<p>Section 438 Cr.P.C. before the Sessions Judge, Thrissur, who by<\/p>\n<p>Annexure-1 order dismissed the petition for the reason that<\/p>\n<p>very serious injuries were caused to the de facto complainant<\/p>\n<p>and the weapons are yet to be recovered.\n<\/p>\n<p>      2. Having heard either side, it is revealed that there is no<\/p>\n<p>serious injuries, but only a lacerated injury. In the above<\/p>\n<p>circumstances, I find that it would be appropriate to allow this<\/p>\n<p>petition.\n<\/p>\n<p>      3. In the result, this petition is allowed. There would be a<\/p>\n<p>direction to   release the petitioners on bail, in the event of<\/p>\n<p>arrest, on executing bail bond for Rs.25,000\/- (Rupees Twenty<\/p>\n<p>five thousand only) each to the satisfaction of the investigating<\/p>\n<p>officer on the following conditions:-\n<\/p>\n<blockquote><p>    i)   The    petitioners    shall   report    before  the<\/p>\n<p><span class=\"hidden_text\">B.A.No.1777 of 2009        2<\/span><\/p>\n<p>            Investigating Officer as and when required by<\/p>\n<p>            him.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>       ii) The petitioners shall not directly or indirectly make<\/p>\n<p>            any inducement, threat or promise to any person<\/p>\n<p>            acquainted with the facts of the case so as to<\/p>\n<p>            dissuade them from disclosing such facts to the<\/p>\n<p>            Court or to any police officer.<\/p><\/blockquote>\n<p>                                   P.S.GOPINATHAN, JUDGE<\/p>\n<p>css\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Bijish Aged 23 Years vs State Of Kerala Rep.By The Public on 15 May, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1777 of 2009() 1.
