Merathia\n                                 ---\n                           Judgment\n                               --\n                                                Dated 20h September 2011\n\nBy Court:   Both these appeals are directed against the judgement of<\/pre>\n<p>conviction and order of sentence dated 13.07.2001 passed by the<br \/>\nlearned 2nd Additional Sessions Judge, Seraikela in Sessions Trial No.<br \/>\n613 of 1990 convicting the appellants under sections 307\/34 IPC and<br \/>\nsentencing them to undergo R.I. for seven years.\n<\/p>\n<p>2.    Learned counsel for the appellants submitted that the main<br \/>\naccused in both these appeals was Bijoy Kumar Ojha who had filed a<br \/>\nseparate appeal being Cr. Appeal No. 391 of 2001 which has been<br \/>\ndisposed of consequent upon his release from jail after serving his<br \/>\nsentence. So far as these appellants are concerned, the appellant-Ajay<br \/>\nKumar Ojha happens to be brother of Bijoy Kumar Ojha and<br \/>\nappellant-Ashok Kumar Mishra happens to be the neighbour of the<br \/>\ninformant and there is general allegation against them and against<br \/>\none Surendra that they instigated the main accused-Bijoy Kumar Ojha<br \/>\nto fire at the informant. Except this, there is no overt act attributed to<br \/>\nthese appellants; and that they have remained in jail for about three<br \/>\nmonths and they have suffered this prosecution since 1989.\n<\/p>\n<p>3.    Learned   counsel    for    the   State   supported   the   impugned<br \/>\njudgment and submitted that the prosecution has proved it&#8217;s case<br \/>\nbeyond all reasonable doubts.\n<\/p>\n<p>4.    The prosecution case in short is that on 7.9.1989 the informant<br \/>\ncame to his house on the scooter of Braj Mohan who lives in front of<br \/>\nhis house and kept the scooter in the house of Braj Mohan after<br \/>\n opening the lock and started going to his house. The accused Bijoy<br \/>\nwhose house was situated in front of the house of the informant, was<br \/>\nsitting along with his younger brother Ajay Kumar Ojha on the cot<br \/>\nand on the same cot, his neighbours Ashok, Surendra and one boy<br \/>\nwere sitting. On seeing the informant, all these persons stood up and<br \/>\naccused Bijoy Ojha demanded key from him to which he refused<br \/>\nwhereupon Bijoy Ojha told him that if he did not hand over the key to<br \/>\nhim, then he would be shot dead. Other persons named above told<br \/>\nBijoy Ojha to fire at the informant if he did not hand over the key. Out<br \/>\nof fear, when the informant started handing over the key to Bijoy<br \/>\nOjha, he shot at the left thigh of the informant and snatched the key<br \/>\nfrom his hand. Thereafter, all the accused persons fled away. The<br \/>\ninformant was taken to hospital for treatment. The reason behind the<br \/>\nincident was that the accused persons wanted to grab the quarter of<br \/>\nBraj Mohan.\n<\/p>\n<p>5.    PW1 is the informant of the case who fully supported the<br \/>\nprosecution case. PW3 is the doctor who examined the informant on<br \/>\n7.9.1989 and found punctured wound in the left thigh measuring<br \/>\n1&#8243;x1&#8243; and multiple superficial punctured wound surrounding the<br \/>\npunctured wound. He opined that the injuries were caused by<br \/>\npenetrating substance such as firing from country made pistol.\n<\/p>\n<p>6.    PW2-Savitri Devi is the mother of the informant who supported<br \/>\nthe prosecution case, by saying that on hearing the sound of firing,<br \/>\nshe came out of her house and found the informant injured. PWs 4<br \/>\nand 6 were tendered and PW5 was declared hostile.\n<\/p>\n<p>7.    After hearing the parties and going through the materials<br \/>\nbrought on record, it appears that there is vague and general<br \/>\nallegation against these appellants that they instigated the main<br \/>\naccused Bijoy Ojha to fire at the informant. In my opinion, the<br \/>\nappellants deserve the benefit of doubt.\n<\/p>\n<p>8.    In the circumstances, these appeals are allowed. The judgement<br \/>\nof conviction passed against the appellants under sections 307\/34 IPC<br \/>\nby the trial court, is hereby set aside. The appellants are acquitted of<br \/>\nthe charges. The appellants are on bail, they are discharged from the<\/p>\n<p>liabilities of their bail bonds.\n<\/p>\n<p>                                                  (R.K.
