Under such circumstances, the ad-interim relief<br \/>\n\tearlier granted in terms of paragraph 5B vide order dated 1.3.2011<br \/>\n\trequires to be confirmed. However, Mr.Joshi, ld.advocate for the<br \/>\n\topponent &#8211; respondent states that in the instant case, the<br \/>\n\tacquisition process commenced since 1991 and till today, the<br \/>\n\topponent &#8211; respondent &#8211; original claimant has not received any<br \/>\n\treasonable amount by way of compensation and, therefore, requested<br \/>\n\tthat the amount deposited by the applicants &#8211; appellants may<br \/>\n\tbe disbursed to the opponent &#8211; respondent.\n<\/p>\n<p>\tHaving considered<br \/>\n\tthe facts and circumstances of the case, so also the submissions<br \/>\n\tadvanced on behalf of both the sides, this Court is of the opinion<br \/>\n\tthat the 50% amount, out of the amount deposited by the applicants,<br \/>\n\tpursuant to the earlier order dated 1.3.2011, shall be disbursed to<br \/>\n\tthe opponent &#8211; respondent, on the condition that, at the time<br \/>\n\tof withdrawal of the aforesaid 50% amount, the opponent &#8211;<br \/>\n\trespondent shall file undertaking in form of affidavit before the<br \/>\n\treference Court, to the effect that in case if the appeal preferred<br \/>\n\tby the State shall be allowed in future and the opponent &#8211;<br \/>\n\trespondent would be required to re-deposit the amount, which he<br \/>\n\twould withdraw, the opponent respondent shall immediately re-deposit<br \/>\n\tthe amount before the reference Court.\n<\/p>\n<p>\tThe remaining 50%<br \/>\n\tamount deposited by the applicants &#8211; appellants shall be<br \/>\n\tinvested by the reference Court in any nationalised bank in the<br \/>\n\tfixed deposit, initially for a period of 3 years, which period shall<br \/>\n\tbe liable to be extended at the interval of every one year till the<br \/>\n\tappeal is finally decided. The reference Court shall invest the<br \/>\n\tamount in such fixed deposit wherein the amount of interest is<br \/>\n\taccumulated.\n<\/p>\n<p>\tSubject to the<br \/>\n\tabove direction, the stay earlier granted shall continue till the<br \/>\n\tpendency of the appeal.\n<\/p>\n<p>\tRule is made<br \/>\n\tabsolute accordingly. The application stands disposed of<br \/>\n\taccordingly.
