Justice J.M.JAMES\n\n Dated :15\/11\/2006\n\n O R D E R\n                             J.M.JAMES, J.\n\n                              -------------------\n\n                         W.P.(C). 7675\/2006\n\n                             --------------------\n\n             Dated this  15th day of November, 2006\n\n\n                             JUDGMENT\n<\/pre>\n<p>               The petitioners had availed  loan under various<\/p>\n<p>loan   facilities,     as   could   be   seen   from   Ext.P1,     from   the<\/p>\n<p>third   respondent-bank.     The   payments   were   not   effected<\/p>\n<p>and   premium was not paid.   Because of the default,   the<\/p>\n<p>bank  initiated   steps   against   them,  as   could   be   seen   from<\/p>\n<p>Exts.   P2   to   P6.     Therefore,   writ   petitioners   came   before<\/p>\n<p>this Court praying, inter alia, to direct the respondents to<\/p>\n<p>provide   adequate   monthly   instalment     facilities   to   them,<\/p>\n<p>and   to   allow   them   to   pay   the   amounts,   due   to   the   third<\/p>\n<p>respondent,   after   the   latter   supplying   the   detailed<\/p>\n<p>statements of account of the debts of the writ petitioners.<\/p>\n<p>       2.     When   the   writ  petition   came   up  for   admission,<\/p>\n<p>this     Court,     as  per   the   order   dated   15.3.2006,     directed<\/p>\n<p>the   petitioners to remit an amount of Rs.75,000\/-, within<\/p>\n<p>two   months   from   that   date   and   also   continue   to   pay   an<\/p>\n<p>instalment of Rs.40,000\/- each per month,  on the last day<\/p>\n<p>of every succeeding month, computing the period from the<\/p>\n<p>payment of  Rs.75,000\/-, as ordered above.<\/p>\n<p>W.P.(C).7675\/2006<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>      3.     It   is   the   complaint   of     the   third   respondent<\/p>\n<p>that   the   petitioners   had   defaulted   the   payment.<\/p>\n<p>However,   counsel   for   the   writ   petitioners   submit   that<\/p>\n<p>they   had   remitted   an   amount   of   Rs.50,000\/-,     and   the<\/p>\n<p>balance amount was not paid to the third respondent, as<\/p>\n<p>the   conditions   stipulated   in   the   order   of   this   Court   had<\/p>\n<p>elapsed.     The   counsel   further   submitted   that   the<\/p>\n<p>petitioners   are   prepared   to   pay   the   balance     amount   of<\/p>\n<p>Rs.25,000\/-,   as per the order of 15.3.2006, and also the<\/p>\n<p>instalment amount, as ordered by this Court.  Hence the<\/p>\n<p>counsel prays that the instalment amount of Rs.40,000\/-<\/p>\n<p>may   be   reduced   and   they   may   be   allowed   to   remit   the<\/p>\n<p>amount  on easy instalments.\n<\/p>\n<\/p>\n<p>      4.     After hearing   both sides and considering the<\/p>\n<p>facts   that   are   placed   before   me,     together     with   the<\/p>\n<p>submissions   of   the   learned   counsel   for   the   third<\/p>\n<p>respondent, I direct  as follows:-\n<\/p>\n<\/p>\n<blockquote><p>            (a).     The writ petitioners shall remit an amount<\/p>\n<p>            of Rs.25,000\/- within 15 days from today before<\/p>\n<p>            the   third   respondent.              Immediately   on<\/p>\n<p>            remittance   of   that   amount,   the   third<\/p>\n<p>            respondent-bank,   shall   supply   the   writ<\/p>\n<p>W.P.(C).7675\/2006<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>           petitioners   the statement(s) of accounts about<\/p>\n<p>           the balance amount due from them to the third<\/p>\n<p>           respondent,   within   one   week   from   the   date   of<\/p>\n<p>           remittance of Rs.25,000\/-.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           (b).      The writ petitioners shall remit the entire<\/p>\n<p>           balance amount due to the third respondent in<\/p>\n<p>           15   equal   monthly   instalments,     starting   from<\/p>\n<p>           the   same   date   of   next   succeeding   month,<\/p>\n<p>           paying  Rs.25,000\/-,  as ordered above.<\/p>\n<\/blockquote>\n<blockquote><p>           (c).      There  shall  be no default of any payment<\/p>\n<p>           of   the   instalment   amount   to   the   third<\/p>\n<p>           respondent.
