RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n          W.P.(C).No.36822 of 2008-H\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n     Dated this the 6th day of January, 2009.\n\n                   JUDGMENT\n<\/pre>\n<p>This   writ   petition    is   filed   challenging<\/p>\n<p>disciplinary  proceedings.      According  to the<\/p>\n<p>petitioner, the only allegation against him is<\/p>\n<p>that he had availed casual leave for nearly a<\/p>\n<p>week on grounds attributable to ill-health. He<\/p>\n<p>alleges that neither the Enquiry Officer nor the<\/p>\n<p>Disciplinary Authority is entitled to sit in<\/p>\n<p>judgment over the wisdom of the medical expert<\/p>\n<p>who granted the certificate. As of now, during<\/p>\n<p>the  pendency   of   this    writ   petition, the<\/p>\n<p>petitioner  has  been    terminated  from  service<\/p>\n<p>following the decision of the Sub Committee of<\/p>\n<p>the employer society. The petitioner, therefore,<\/p>\n<p>has an intra-institutional appeal to the Board of<\/p>\n<p>Directors (Committee). After exhausting that, he<\/p>\n<p>may even have remedy by way of arbitration under<\/p>\n<p><span class=\"hidden_text\">WP(C)36822\/08          -: 2 :-<\/span><\/p>\n<p> Section 69 of the KCS Act.      But, it is pointed<\/p>\n<p> out    on   behalf  of   the  petitioner that  the<\/p>\n<p> petitioner is due to retire by the last working<\/p>\n<p> day of June, 2009 and it will only be continued<\/p>\n<p> harassment to keep him out of office. Under such<\/p>\n<p> circumstances,    this  writ  petition  is ordered<\/p>\n<p> directing that if the petitioner files his appeal<\/p>\n<p> to the committee at the earliest, that will be<\/p>\n<p> considered and disposed of within a period of two<\/p>\n<p> weeks from the date of receipt of that appeal and<\/p>\n<p> a decision rendered to facilitate the petitioner<\/p>\n<p> to move the appropriate authority for further<\/p>\n<p> statutory remedy, if necessary.
