(Oral)\n<\/pre>\n<p>            In this petition filed under Article 226 of the Constitution of<\/p>\n<p>India, the prayer made is for issuance of a writ in the nature of certiorari<\/p>\n<p>quashing the action of the respondents in effecting recovery from the<\/p>\n<p>petitioner of the amount released to the petitioner as special increments.<\/p>\n<p>After retirement of the petitioner, the pensionary benefits have been<\/p>\n<p>withheld so as to effect the recovery.     Challenge in this regard is to<\/p>\n<p>Annexures P-2 and P-3, under which recovery has been ordered to be<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 9834 of 2009                           2<\/span><\/p>\n<p>effected from the petitioner.\n<\/p>\n<p>            Learned counsel for the petitioner states that the petitioner<\/p>\n<p>has been working as Driller since 1.8.1981, whereafter he was promoted<\/p>\n<p>as Chargeman on 1.4.1987. Due to exigencies of service required on<\/p>\n<p>Ranjit Sagar Dam, certain special increments were given to the petitioner<\/p>\n<p>and other persons. The petitioner retired as Chargeman on 29.2.2008. On<\/p>\n<p>27.10.2008, vide order (Annexure P-2), the respondents have ordered<\/p>\n<p>recovery of the special increments released in favour of the petitioner.<\/p>\n<p>Vide order dated 14.1.2009 (Annexure P-3), a further sum of Rs.15,540\/-<\/p>\n<p>has been ordered to be recovered from the pensionary benefits, also on<\/p>\n<p>account of withdrawal of special increments.\n<\/p>\n<p>            Learned counsel for the petitioner states that the issue raised<\/p>\n<p>in this petition is covered by the judgment of this Court dated 27.5.2009<\/p>\n<p>rendered in CWP 5568 of 2008 <a href=\"\/doc\/46565758\/\">(Charan Dass and others v. State of<\/p>\n<p>Punjab and others<\/a>).\n<\/p>\n<p>            Learned counsel for the respondent-State has not been able to<\/p>\n<p>dispute the facts, as given out above.\n<\/p>\n<p>            Learned counsel for the respondent-State has further not been<\/p>\n<p>able to distinguish the judgment rendered in the case of Charan Dass<\/p>\n<p>(supra).\n<\/p>\n<p>            I have considered the issue.\n<\/p>\n<p>            The relevant portion from the judgment rendered in the case<\/p>\n<p>of Charan Dass (supra) reads as under:-\n<\/p>\n<blockquote><p>                   &#8220;It is admitted case of the parties that the work<br \/>\n            charge period is to be counted as qualifying period for the<br \/>\n            grant of pensionary benefits and thus the emoluments<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 9834 of 2009                         3<\/span><\/p>\n<p>            drawn by the employee as work charge employee had to<br \/>\n            be considered as also the period when the employee<br \/>\n            served in work charge capacity. It is admitted case of the<br \/>\n            parties that the benefit of retrenchment increments and<br \/>\n            special increments was granted to the employees during<br \/>\n            the period they were serving in work charge capacity<br \/>\n            without any misrepresentation or fraud on their part. The<br \/>\n            benefit allowed to the petitioners is, however, sought to be<br \/>\n            withdrawn after take over and regularisation by the State<br \/>\n            Government      with       effect   from   13.3.1996.   The<br \/>\n            retrenchment increments were allowed to bring their<br \/>\n            salary and emoluments at par with other employees in the<br \/>\n            revised pay scale, keeping in view their last drawn salary<br \/>\n            as retrenchees. No reasons have been given in the reply as<br \/>\n            to how such benefit is impermissible or illegal. The State,<br \/>\n            however, has attempted to justify its action regarding<br \/>\n            withdrawal of special and retrenchment increments.<br \/>\n            Admittedly, special increments were granted from time to<br \/>\n            time to some of the employees\/petitioners for their alleged<br \/>\n            good work. There was no uniform policy and benefit of<br \/>\n            special increments was given on selective basis. In so far<br \/>\n            as the retrenchment increments are concerned, there<br \/>\n            cannot be any second opinion that the benefit was granted<br \/>\n            to bring their wages at par under the revised pay scale<br \/>\n            and that too before their take over by the State<br \/>\n            Government.<\/p>\n<blockquote><p>                  As regards the grant of special increments is<br \/>\n            concerned, it was selectively granted from person to<br \/>\n            person and is not justified. However, one fact remains<br \/>\n            common in regard to grant of both the benefits i.e.<br \/>\n            retrenchment increments and special increments that the<br \/>\n            said benefits were conferred upon the petitioners without<br \/>\n            any misrepresentation or fraud on their part. The issue is<br \/>\n            squarely covered by the Full Bench judgment of this<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 9834 of 2009                         4<\/span><\/p>\n<p>            Court passed in CWP No.2799 of 2008 alongwith other<br \/>\n            connected matters <a href=\"\/doc\/1434376\/\">(Budh Ram and others vs. State of<br \/>\n            Haryana and others<\/a>) decided on 22.5.2009. The case of the<br \/>\n            petitioners falls in category ii) wherein following<br \/>\n            observations have been made:-\n<\/p><\/blockquote>\n<blockquote><p>                  &#8220;It is in the light of the above pronouncement, no<br \/>\n                  longer open to the authorities granting the benefits,<br \/>\n                  no matter erroneously, to contend that even when<br \/>\n                  the employee concerned was not at fault and was<br \/>\n                  not in any way responsible for the mistake<br \/>\n                  committed by the authorities, they are entitled to<br \/>\n                  recover the benefit that has been received by the<br \/>\n                  employee on the basis of any such erroneous grant.<br \/>\n                  We say so primarily because if the employee is not<br \/>\n                  responsible for the erroneous grant of benefit to<br \/>\n                  him\/her, it would induce in him the belief that the<br \/>\n                  same was indeed due and payable. Acting on that<br \/>\n                  belief the employee would, as any other person<br \/>\n                  placed   in   his    position   arrange   his   affairs<br \/>\n                  accordingly which he may not have done if he had<br \/>\n                  known that the benefit being granted to him is likely<br \/>\n                  to be withdrawn at any subsequent point of time on<br \/>\n                  what may be then said to be the correct<br \/>\n                  interpretation and application of rules. Having<br \/>\n                  induced that belief in the employee and made him<br \/>\n                  change his position and arrange his affairs in a<br \/>\n                  manner that he would not otherwise have done, it<br \/>\n                  would be unfair, inequitable and harsh for the<br \/>\n                  Government to direct recovery of the excess amount<br \/>\n                  simply because on a true and correct interpretation<br \/>\n                  of the rules, such a benefit was not due&#8230;&#8230;<br \/>\n                  We have, therefore, no hesitation in holding that in<br \/>\n                  case the employees who are recipient of the benefits<br \/>\n                  extended to them on an erroneous interpretation or<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 9834 of 2009                            5<\/span><\/p>\n<p>                   application of any rule, regulation, circular and<br \/>\n                   instructions have not in any way contributed to such<br \/>\n                   erroneous interpretation nor have they committed<br \/>\n                   any fraud, misrepresentation, deception to obtain<br \/>\n                   the grant of such benefit, the benefit so extended<br \/>\n                   may be stopped for the future, but the amount<br \/>\n                   already paid to the employees cannot be recovered<br \/>\n                   from them&#8230;.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>                   In view of the above, the respondents are not<br \/>\n             entitled to effect any recovery from the petitioners either<br \/>\n             on account of retrenchment increments or special<br \/>\n             increments allegedly erroneously given. However, the<br \/>\n             respondents are entitled to re-fix the emoluments by<br \/>\n             reducing the special increment only. Consequently the pay<br \/>\n             of the petitioners will be re-fixed and in case of those<br \/>\n             employees who have already retired from service, the<br \/>\n             retiral benefits shall be released within a period of two<br \/>\n             months. The petitioners shall also be entitled to interest on<br \/>\n             the delayed payment of pension\/retiral benefits at the<br \/>\n             statutory rate wherever admissible and at the rate of 6%<br \/>\n             on pension and other retiral benefits where statutory<br \/>\n             interest is not provided for. Any amount deducted from<br \/>\n             the retiral benefits or the salary of the petitioners shall be<br \/>\n             refunded within the aforesaid period.\n<\/p><\/blockquote>\n<blockquote><p>                   Ordered accordingly.
