The applicant<br \/>\nis convicted for an offence under Sections 302, 114 and 326 of the<br \/>\nIndian Penal Code and also under Section 135 of the Bombay Police<br \/>\nAct.  He is awarded life imprisonment, fine of Rs.5000\/- and in<br \/>\ndefault, 2 years&#8217; imprisonment.  He is convicted on 24.08.2009.  By<br \/>\n23.04.2011, he has undergone 3 years, 7 months and 4 days.\n<\/p>\n<p>3.1\t\tOn 15.11.2010, the<br \/>\nCourt granted him temporary bail for a period of 6 months on account<br \/>\nof ailment by which he is suffering, i.e. Ischemic<br \/>\nCerebrovascular Stroke. He is suffering from paralytic attack.\n<\/p>\n<p>4.\t\tLearned Advocate<br \/>\nMs.Banna Dutta places on record a xerox copy of certificate issued by<br \/>\nthe Assistant Professor of Orthopedics, Government Medical College &amp;<br \/>\nNew Civil Hospital, Surat, wherein it is stated that the applicant is<br \/>\n65% permanently physically disabled.  Learned Advocate for the<br \/>\napplicant submitted that without the help of family member, he is not<br \/>\ncomfortable in discharging even his daily routine.  He is also under<br \/>\nmedical treatment.  In view of that, learned Advocate for the<br \/>\napplicant requested that as an exceptional case, he be granted<br \/>\nregular bail.\n<\/p>\n<p>5.\t\tThe<br \/>\napplicant is present in the Court.  The Court has seen his movement<br \/>\nin the Court.  With difficulty, he could come forward with assistance<br \/>\nof his wife, who is also present in the Court.  On inquiry, he states<br \/>\nthat he has two sons, but they are also convicted and are in jail.<br \/>\nAt present, he is supported by his wife.<br \/>\n His wife stated that by doing petty labour work, she is maintaining<br \/>\nherself and her husband.\n<\/p>\n<p>6.\t\tTaking into<br \/>\nconsideration the aforesaid exceptional circumstances, the Court<br \/>\ndeems it proper to allow the present application and suspend the<br \/>\nsentence of life imprisonment.\n<\/p>\n<p>7.\t\tAccordingly<br \/>\nthe application is allowed.  The sentence of life imprisonment<br \/>\nimposed by the learned District Judge, Valsad in Sessions Case No.56<br \/>\nof 2007 is suspended till the final disposal of the main Criminal<br \/>\nAppeal.  The applicant is ordered to be released on regular bail on<br \/>\nhis executing a personal bond of Rs.5,000\/- (Rupees Five Thousand<br \/>\nOnly) to the satisfaction of the Jail authorities, and<br \/>\nsubject to the conditions that he shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or abuse liberty;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of residence to the I.O. and also to the lower<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station once in a month<br \/>\n\tmore particularly between 1st and 10th of<br \/>\n\tmonth between 10.00 a.m. And 2.00;\n<\/p>\n<p>not<br \/>\n\tleave the limits of the country without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, within a week to the lower Court;\n<\/p>\n<p>8.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\t\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>10.\t\tRule is made<br \/>\nabsolute.\n<\/p>\n<p>\t\tA copy of this order<br \/>\nbe made available to learned APP Mr.Pandya for its onward<br \/>\ncommunication.\n<\/p>\n<p>\t\tRegistry is directed<br \/>\nto communicate this order to the jail authorities.\n<\/p>\n<p>\t\t\t\t\t\t\t(Ravi<br \/>\nR.Tripathi, J.)<\/p>\n<p>\t\t\t\t\t\t\t(P.P.Bhatt,<br \/>\nJ.)<\/p>\n<p>*Shitole<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Dhedabhai vs State on 26 April, 2011 Author: Ravi R.Tripathi,&amp;Nbsp;Mr.Justice P.P.Bhatt,&amp;Nbsp;
