On 27th<br \/>\nJuly, 1995 in  bus in which the respondent was discharging his duties<br \/>\nas a conductor was checked by the Checking Squad and it was found<br \/>\nthat the respondent had collected fare from three passengers but had<br \/>\nnot issued tickets.  Upon the conclusion of the departmental inquiry<br \/>\nthe petitioner ordered dismissal of respondent from service.  The<br \/>\nrespondent challenged the punishment before the Labour Court by<br \/>\nraising a dispute.  The Labour Court in its impugned award came to<br \/>\nthe conclusion that there was no dishonest intention on the part of<br \/>\nthe respondent in not issuing the tickets.  The Labour Court however,<br \/>\nconcluded that the respondent erred in not issuing the tickets and to<br \/>\nthat extent he had committed misconduct.  In the result, the Labour<br \/>\nCourt was pleased to set aside the order of dismissal.  The workman<br \/>\nwas ordered to be reinstated in service without back wages and<br \/>\npunishment of withholding of two increments permanently was ordered<br \/>\nto be imposed on him.\n<\/p>\n<p>3.\tWhile<br \/>\nadmitting the petition, this Court had not granted stay against<br \/>\nreinstatement of the workman.  The petitioner employer, therefore,<br \/>\nsubject to outcome of the petition reinstated the respondent.<br \/>\nLearned advocate Shri Raval appearing for the petitioner submits that<br \/>\nhaving been worked from the year 2001 upon reinstatement the<br \/>\nrespondent had also reached the age of superannuation and is made to<br \/>\nretire w.e.f. 30th April, 2005.\n<\/p>\n<p>4.\tIn<br \/>\nso far as the conclusion of the Labour Court regarding the<br \/>\ninvolvement of the respondent is concerned, I am unable to agree with<br \/>\nthe same.  In the departmental inquiry through cogent evidence, it<br \/>\nwas held that the respondent though had collected fare from three<br \/>\npassengers he had not issued tickets to them.  The bus was checked<br \/>\nafter considerable distance after the passengers boarded the bus.<br \/>\nTherefore there was no excuse on the part of the respondent in not<br \/>\nissuing the tickets.  Ordinarily, therefore, this Court would have<br \/>\nbeen inclined to restore the punishment imposed by the employer.  In<br \/>\nthe present case, however, there are certain  mitigating<br \/>\ncircumstances.  As recorded earlier the respondent was reinstated<br \/>\npursuant to the award passed by the Labour Court.  Since then he had<br \/>\nalready crossed the age of superannuation.  The Labour Court has<br \/>\nrecorded that this is the first misconduct of the respondent.  There<br \/>\nis no contrary material available on record to disregard this<br \/>\nobservation of the Labour Court.  The Labour Court in its direction<br \/>\nhad provided for withholding of entire back wages and had ordered<br \/>\nimposition of punishment of withholding of two increments with future<br \/>\neffect.  Considering all these aspects of the matter, I find it<br \/>\ninequitable in facts of the present case to permit the petitioner to<br \/>\nhave resort to the original penalty of dismissing the respondent from<br \/>\nservice.  The respondent having committed misconduct can also not be<br \/>\nallowed to go scot free.  In facts of the present case, therefore, I<br \/>\nfind that ends of justice would be served if the respondent is<br \/>\nordered to be visited with the penalty of withholding of four<br \/>\nincrements with future effect instead of two as ordered by the Labour<br \/>\nCourt.  The award of the Labour Court is modified accordingly.  Now<br \/>\nthat the litigation with respect to the dismissal of the respondent<br \/>\nhas come to an end, it is expected that the petitioner  shall release<br \/>\nthe post retiral dues of the respondent after implementing the<br \/>\npenalty as directed in this order.  Petition is allowed to the above<br \/>\nextent.
