The petitioners have approached this Court through the present petition filed under Article 227 of the Constitution of India. They are aggrieved against the orders dated August 28, 2001 passed by the learned trial Court and orders dated August 1, 2002 passed by learned District Judge. Vide the aforesaid orders, the prayer of the plaintiffs claiming ad-interim injunction has been declined and consequently their application filed under Order 39 Rules 1 and 2 of the Code of Civil Procedure was dismissed.\n<\/p>\n<p>2. The plaintiffs filed a suit for permanent injunction. It was claimed by them that they alongwith defendants are the co-owners of the suit property. However, it was claimed that the plaintiffs are in exclusive possession of the suit property. Accordingly, the plaintiffs maintained that the defendants have no right to dispossess the plaintiffs from the suit land. Alongwith the suit, the plaintiff also moved an application under Order 39 Rules 1 and 2 of the Code claiming ad interim injunction.\n<\/p>\n<p>3. The suit as well as the application was contested by the defendants. The defendants maintained that the plaintiffs had earlier filed a civil suit which was dismissed as withdrawn. The defendants also denied that the plaintiffs were in exclusive possession of the suit property.\n<\/p>\n<p>4. The learned trial Court found that the parties were the co-sharers of the suit land and the plaintiffs had failed to prove that they were in exclusive possession of the suit property. Accordingly, the application filed by the plaintiffs seeking ad interim injunction was rejected.\n<\/p>\n<p>5. The matter was taken up in appeal. The learned first Appellate Court again examined the material available on the record. On the basis of the aforesaid facts, the learned first appellate Court also found that the plaintiffs have not been able to prove their exclusive possession over the suit property but they were merely co-sharers in the suit land alongwith others. On that basis, the appeal filed by the plaintiffs was also dismissed.\n<\/p>\n<p>6. The defendant-respondents have chosen to file a reply dated October 5, 2003 to the petition filed by the plaintiff-petitioners. In the aforesaid reply, the defendants have stated that Puran Singh, father of the plaintiffs, Kapur Singh, predecessor-in-interest of respondents and Amar Singh were co-sharers of land measuring 54 Kanals 11 Marlas besides other land. The defendants had filed an application for partition of the aforesaid land measuring 54 Kanals 1 Maria. The said application was allowed by the Assistant Collector 1st Grade, Gurdaspur vide order dated November 17, 1997. Puran Singh, father of the plaintiffs filed an application against the order of partition. The matter was remanded back vide order dated December 18, 1999 for fresh decision. The Assistant Collector 1st Grade redecided the partition application vide order dated July 28, 2000 and the land measuring i 8 Kanals 4 Marlas was allotted to the plaintiffs and their transferees. The land measuring 18 Kanals 3 Marlas was allotted to the heirs of Amar Singh and his transferees. Similarly, land measuring 18 Kanals 3 Marlas was allotted to the defendants as well.\n<\/p>\n<p>7. The plaintiffs filed an appeal against the aforesaid order dated July 28, 2000 before the Collector, Gurdaspur. During the pendency of the appeal, the parties entered into a compromise. The order of partition passed by the Assistant Collector 1st Grade was accepted subject to the condition that the defendants would execute the sale deed with regard to 2 Kanals 3 marlas of land bearing Khasra No. 25R\/8\/3 which adjoins the road in favour of plaintiffs No. 1. On December 27, 2000, defendant-respondent No. 1, accordingly, executed the aforesaid sale deed. It was also agreed between the parties that on execution of the sale deed, the plaintiffs would withdraw the appeal filed by them against the order of partition.\n<\/p>\n<p>8. Thus, on execution of the aforesaid sale deed, the appeal filed by the plaintiffs against the order of partition was withdrawn on February 22, 2001. A copy of the order dated February 22, 2001 passed by the Collector, Gurdaspur has been appended as Annexure R-1 with the reply of the defendant-respondents.\n<\/p>\n<p>9. The defendants have further maintained that the plaintiffs filed another suit for permanent injunction against the defendants which was also withdrawn by them on February 1, 2001. A copy of the aforesaid order withdrawing the said suit has been appended as Annexure R-2. On that basis, the defendants-respondents have maintained that the order of partition had attained finality between the parties and the parties are now in possession of their respective shares allotted to them in partition. The defendants had claimed that the petitioners had suppressed also the afore-mentioned facts from this Court.\n<\/p>\n<p>10. It has further been pleaded by the defendants that during the pendency of the present petition, the plaintiffs have still filed another suit for declaration and injunction on October 4, 2002. In the aforesaid suit the plaintiffs had admitted the passing of the orders of partition and dismissal of their appeal but they have challenged the aforesaid proceedings. On that basis, the defendants had claimed that in fact the present petition had been rendered infructuous.\n<\/p>\n<p>11. I have heard Shri U.S. Sahni, the learned counsel appearing for the plaintiff-petitioners and Shri B.R. Mahajan, the learned counsel appearing for the defendant-respondents and with assistance have also gone through the record of the case.\n<\/p>\n<p>12. Besides the fact that the plaintiffs themselves had originally claimed that they are co-sharers with the defendants in the suit property and both the learned Courts below have held that no injunction could be issued against the co-sharer, since the plaintiffs have not been shown to be in exclusive possession, the perusal of the various pleas taken by the defendants and the orders Annexures R\/1 and R\/2 clearly shows that the plaintiff-petitioners have suppressed the material facts from this Court. The factum of any partition proceedings between the parties and the passing of the various orders have been intentionally kept concealed. It has also not been disclosed that during the course of the appeal against the order of Assistant Collector 1st Grade, the parties had entered into a settlement and thereafter, the defendants had executed the sale-deed with regard to the land measuring 2 kanals 3 marlas. Thereafter, the plaintiff had withdrawn their appeal against the order of partition. The defendants have specifically pleaded that the partition had attained finality between the parties. The parties are in possession of their respective portions falling to their shares in the partition proceedings. The defendant-respondents have also appended a copy of the plaintiff dated October 4, 2002 as Annexure R-3. A perusal of the aforesaid plaint clearly shows that the present plaintiff-petitioners have themselves filed a fresh suit challenging the aforesaid partition proceedings. Thus, the suit for permanent injunction filed by the plaintiffs itself apparently has been rendered infructuous. In any case, the present revision petition filed by them has been so rendered infructuous,<\/p>\n<p>13. Even otherwise, I find that the plaintiffs have no grievance to make against the orders passed by the learned courts below. Once the parties are in exclusive possession of their respective shares, the question of issuance of any ad interim injunction qua the suit property, in their favour would not arise.\n<\/p>\n<p>14. In view of the aforesaid discussion, I do not find any merit in the present revision petition and the same is, accordingly, dismissed.\n<\/p>\n<p>15.
