JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/03\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nfiling these petitions, the petitioners have prayed for issuance of<br \/>\nan appropriate writ or direction, directing the respondent-Gujarat<br \/>\nState Road Transport Corporation to decide the applications filed by<br \/>\nthe petitioners for grant of appointment on compassionate grounds, as<br \/>\nper the prevailing policy. All the petitioners have made applications<br \/>\nto the respondent-Corporation for giving them appointments on the<br \/>\npost of Clerk.\n<\/p>\n<p>2.\tIn<br \/>\nthe affidavit-in-reply filed by the  respondents, it is stated that<br \/>\nthere are no vacant posts of Clerks in the respondent-Corporation.\n<\/p>\n<p>3.\tToday,<br \/>\nwhen the matters are taken up for hearing Mr.Mukesh H.Rathod, learned<br \/>\nadvocate for the petitioners states, upon instructions, that the<br \/>\npetitions may be disposed of with a direction to the<br \/>\nrespondent-Corporation to consider the case of the petitioners, as<br \/>\nand when the posts of  Clerks are available.\n<\/p>\n<p>4.\tMr.Shalin<br \/>\nN.Mehta, learned advocate for Mr. Hemang M.Shah, learned advocate for<br \/>\nthe respondents has submitted that the respondents will consider the<br \/>\ncase of the petitioners for grant  of appointments on compassionate<br \/>\ngrounds, as and when the posts of Clerks are available, in accordance<br \/>\nwith law.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned advocates for the respective parties and in view of<br \/>\nthe above statements made by them,  the following order is passed:\n<\/p>\n<p>\tThe<br \/>\n respondent-Corporation may consider the case of the petitioners for<br \/>\ngrant of compassionate appointment on the posts of Clerks, as and<br \/>\nwhen the said posts are advertised, in accordance with law.\n<\/p>\n<p>6.\tThe<br \/>\npetitions are disposed of, in the above terms, with liberty to the<br \/>\npetitioners to approach this Court, in case of difficulty.\n<\/p>\n<p>7.\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>   \t\t           \t(Smt.Abhilasha Kumari,J)<\/p>\n<p>arg<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rajendrasinh vs Gujarat on 29 March, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
