Singh, A.P.P.<\/p>\n<p>                                                      &#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>3.   12.09.2011               The accused-petitioner has preferred<\/p>\n<p>                  this revision application against the judgment<\/p>\n<p>                  and order dated 17th June 2011 passed by the<\/p>\n<p>                  learned      Additional       Sessions      Judge,       III,<\/p>\n<p>                  Bhojpur, Ara in Cr. Appeal No. 6 of 1997 by<\/p>\n<p>                  which the judgment of conviction and order of<\/p>\n<p>                  sentence dated 28.1.1997 passed by the learned<\/p>\n<p>                  1st Assistant Sessions Judge, Ara in Sessions<\/p>\n<p>                  Trial No. 512 of 1989 has been confirmed and<\/p>\n<p>                  the appeal has been dismissed.\n<\/p>\n<p>                              The matter has come for hearing on<\/p>\n<p>                  the matter of grant of bail. Learned counsel<\/p>\n<p>                  for   the   petitioner      has   submitted      that   lower<\/p>\n<p>                  court     records    have    been    received     and   this<\/p>\n<p>                  revision application may be disposed of at this<\/p>\n<p>                  stage itself. Learned counsel for the State has<\/p>\n<p>                  got no objection.\n<\/p>\n<p>                              The     prosecution     case,   in    brief,   is<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>that    in    the    night     of   15\/16     July     1988,    the<\/p>\n<p>informant was sleeping in his cattle shed, at<\/p>\n<p>12 O&#8217;clock in the night he woke up on Hulla of<\/p>\n<p>dacoit-dacoit and went to his house with Bhala<\/p>\n<p>and noticed that dacoits were running with box<\/p>\n<p>and one of the dacoits was going with a box on<\/p>\n<p>his head. The informant gave Bhala blow on the<\/p>\n<p>dacoit who fell down on the ground then another<\/p>\n<p>dacoit fired on the informant causing injuries<\/p>\n<p>on    his    left    hand.     Several      witnesses       arrived<\/p>\n<p>there but the dacoits succeeded in fleeing away<\/p>\n<p>with     looted      articles       worth     Rs.10,000\/-        The<\/p>\n<p>members of the family of the informant saw the<\/p>\n<p>occurrence.\n<\/p>\n<p>             On the basis of the statement of the<\/p>\n<p>informant, Sahpur P. S. Case no. 90 of 1988 was<\/p>\n<p>instituted under Section 395 IPC against 15 to<\/p>\n<p>20    unknown       dacoits.    After       investigation        the<\/p>\n<p>police       submitted       charge-sheet           against      two<\/p>\n<p>accused      under       Sections    395      and     412     I.P.C.<\/p>\n<p>During trial one             accused died and proceeding<\/p>\n<p>was    dropped       against     him.       The     charges    were<\/p>\n<p>framed under Section 395 and 412 I.P.C. against<\/p>\n<p>sole     accused-        petitioner.        After     trial     the<\/p>\n<p>accused- petitioner was acquitted under Section<\/p>\n<p>395 IPC and was held guilty under Section 412<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<p>I.P.C. and he was sentences to undergo rigorous<\/p>\n<p>imprisonment for four years vide judgment and<\/p>\n<p>order dated 28.1.1997. Against                      that judgment<\/p>\n<p>and order, the petitioner filed Cr. Appeal No.<\/p>\n<p>6 of 1997 by which the conviction and sentence<\/p>\n<p>passed    by      the    learned      trial    Court       has     been<\/p>\n<p>upheld and the appeal has been dismissed.<\/p>\n<p>             It has been submitted by the learned<\/p>\n<p>counsel      for     the      petitioner       that        order     of<\/p>\n<p>conviction and sentence passed by the learned<\/p>\n<p>trial Court has been confirmed by the learned<\/p>\n<p>Appellate Court. There is concurrent finding of<\/p>\n<p>both the courts below. The occurrence has taken<\/p>\n<p>place on 15\/16 July 1988. More than 23 years<\/p>\n<p>have     passed         and    the    petitioner           has     been<\/p>\n<p>suffering      from      mental      agony    and     he    is     aged<\/p>\n<p>about 70 years. He has been in custody prior to<\/p>\n<p>trial and after the conviction also. He has<\/p>\n<p>been    in     custody        for    about    six    and     a     half<\/p>\n<p>months.\n<\/p>\n<p>             Learned counsel for the State could<\/p>\n<p>not controvert the contention of petitioner.<\/p>\n<p>             After       hearing       learned       counsel        for<\/p>\n<p>both the parties and on perusal of material on<\/p>\n<p>record,      it    appears      that    the    occurrence           has<\/p>\n<p>taken     place      more      than     23    years        ago.     The<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>          petitioner   has        been    suffering       from    mental<\/p>\n<p>          agony. He is also in custody for some time. The<\/p>\n<p>          petitioner is also an old man and his sentence<\/p>\n<p>          deserves to be modified.\n<\/p>\n<p>                    Considering             the          facts        and<\/p>\n<p>          circumstances, the sentence of the petitioner<\/p>\n<p>          is reduced to the period already undergone in<\/p>\n<p>          custody. To this extent, the sentence passed by<\/p>\n<p>          the learned Appellate Court is modified.
