Shah, learned advocate appearing for the appellant submits that<br \/>\nthe accused respondent has remained unserved as he has tendency to<br \/>\nevade the process of law. He submitted that in view of this, the<br \/>\nCourt may issue notice, which may be made returnable after sometime<br \/>\nand the notice be served by the concerned police station of the area<br \/>\nand report be called for.\n<\/p>\n<p>\tThe<br \/>\nrequest appears to be reasonable. In view of this, let there be a<br \/>\nnotice to respondent no. 1 &#8211; original accused returnable on<br \/>\n10.05.2010. The notice, in addition to the usual course be also<br \/>\nserved by concerned police station of the area in which the accused<br \/>\nis shown to have been residing i.e. the address in the memo of<br \/>\nappeal.
