Case of the petitioner is that the respondent No.4<\/p>\n<p>     was elected to the post of Up-Sarpanch of Gram Panchayat,<\/p>\n<p>     Kundel.  The respondent No.4 was disqualified to contest<\/p>\n<p>     or to get elected on any post of Gram Panchayat under the<\/p>\n<p>     provisions of Section 36 (1) (a) (ii) of the Chhattisgarh<\/p>\n<p>     Panchayat Raj Adhiniyam, 1993 (for short &#8220;the Adhiniyam,<\/p>\n<p>     1993&#8221;).  The Collector dismissed the complaint filed by<\/p>\n<p>     the petitioner against the election of respondent No.4 on<\/p>\n<p>     the ground that conviction of the respondent No.4 for<\/p>\n<p>     offences punishable under sections 363, 366 &amp; 376 (1) of<\/p>\n<p>     Indian Penal Code, has been stayed by the High Court in<\/p>\n<p>     appeal being criminal appeal No. 699 of 2005 (Ravi Kumar<\/p>\n<p>     v.  State  of  Chhattisgarh).  Thus, there  is  no<\/p>\n<p>     disqualification under the provisions of Section 36 (1)<\/p>\n<p>     (a) (ii) of the Adhiniyam, 1993.\n<\/p>\n<p>2.   Shri Tripathi submits that the disqualification<br \/>\nincurred by the respondent No.4 still subsists, as the<br \/>\nCollector has wrongly interpreted or understood the order<br \/>\ndated 12-1-2006 passed by this Court in Ravi Kumar (Supra)<br \/>\nwherein the conviction of the respondent No.4 was not<br \/>\nstayed, but the execution of substantive sentence of<br \/>\nimprisonment was suspended and he was released on bail.<br \/>\nThus, the order of the Collector is perverse and vitiated.\n<\/p>\n<p>3.   On the other hand, Shri Thakur, learned counsel<br \/>\nappearing for the respondent No.4, submits that the<br \/>\npetitioner has no locus, though he may be of a voter of<br \/>\nGram Panchayat, Kundel.\n<\/p>\n<p>4.   Shri Bhaduri, learned counsel appearing for the<br \/>\nState, very fairly submits that the observation of the<br \/>\nCollector while entertaining the complaint filed by the<br \/>\npetitioner and passing the impugned order is not in<br \/>\nconsonance with the settled principles of law and contrary<br \/>\nto the catena of judicial pronouncements made by this<br \/>\nCourt as well as Supreme Court.\n<\/p>\n<p>5.   I have heard learned counsel appearing for the<br \/>\nparties, perused the pleadings and the documents appended<br \/>\nthereto.\n<\/p>\n<p>6.   It is evident that the Collector has not understood<br \/>\nthe facts and law applicable to the case properly.  On<br \/>\nperusal of the order 12-1-2006 passed in Ravi Kumar<br \/>\n(supra), it is clear that this Court has not stayed or<br \/>\nsuspended the conviction of the respondent No.4.  The<br \/>\nsentence imposed upon the respondent No.4 for commission<br \/>\nof offences punishable under Sections 363, 366 &amp; 376 (1)<br \/>\nof the Indian Penal Code was suspended and he was released<br \/>\non bail.\n<\/p>\n<p>7.   With regard to contention of the learned counsel for<br \/>\nthe respondent No.4 that the petitioner has no locus<br \/>\ndeserves to be rejected, as it is not the case of election<br \/>\npetition filed by the petitioner herein.  It is the<br \/>\ncomplaint made by a voter of the Gram Panchayat wherein<br \/>\nthe respondent No.4 was elected without disclosing the<br \/>\nfact that he has been convicted for the offences<br \/>\npunishable under Sections 363, 366 &amp; 376 (1) of the Indian<br \/>\nPenal Code and has incurred disqualification under the<br \/>\nprovisions of Section 36 (1) (a) (ii) of the Adhiniyam,<br \/>\n1993.  It was for the authorities to consider his case for<br \/>\ndisqualification, if any, to hold any elected post in view<br \/>\nof provisions of Section 36 (1) (a) (ii) of the Adhiniyam,<br \/>\n1993. Thus, I am of the considered view that the Collector<br \/>\nhas wrongly observed that the conviction of respondent No.<br \/>\n4 was stayed and as such, he was not disqualified to hold<br \/>\nthe post of Up-Sarpanch.\n<\/p>\n<p>8.   For the reasons mentioned herein above, the impugned<br \/>\norder dated 27-11-2006 (Annexure P\/1) passed by the<br \/>\nCollector, Dhamtari, is unsustainable and the same is<br \/>\nhereby quashed. The matter is remitted back to the<br \/>\nCollector for consideration of the complaint made by the<br \/>\npetitioner in the light of aforestated observations and<br \/>\npass the order after examining all the facts of the case.\n<\/p>\n<p>9.   In the result, the writ petition is allowed.
