Heard Mr. Shashi Bhushan Singh No.1, learned<\/p>\n<p>                     counsel for the petitioners, Mr. Hirday Prasad Singh, learned<\/p>\n<p>                     A.P.P. for the State and Mr. Shailendra Kumar Jha, learned<\/p>\n<p>                     counsel for the opposite party no.2.\n<\/p>\n<p>                             This application, under Section 482 of the Code of<\/p>\n<p>                     Criminal Procedure, is for quashing the order dated 27.5.2008<\/p>\n<p>                     passed by the court of Sri Lalta Prasad, Judicial Magistrate,<\/p>\n<p>                     Ist Class, Danapur, in Complaint Case No.451(C) of 2006,<\/p>\n<p>                     whereby the petition of the accused-petitioners, filed under<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>Section 245 of the Code of Criminal Procedure to discharge<\/p>\n<p>them, has been rejected.\n<\/p>\n<p>        Learned counsel appearing on behalf of the<\/p>\n<p>petitioners submits that from perusal of the depositions of the<\/p>\n<p>witnesses as contained in Annexure-&#8216;6&#8217; series to this<\/p>\n<p>application, no offence under Sections 147, 323, 504 and 148<\/p>\n<p>of the Indian Penal Code is made out against the accused-<\/p>\n<p>petitioners, but the Judicial Magistrate, has rejected illegally<\/p>\n<p>the petition filed on behalf of the accused-petitioners to<\/p>\n<p>discharge them under Section 245 of the Code of Criminal<\/p>\n<p>Procedure.\n<\/p>\n<p>        Learned counsel appearing on behalf of the opposite<\/p>\n<p>party no.2 submits that in this case charges have already been<\/p>\n<p>framed by the trial court and almost all the witnesses have<\/p>\n<p>been examined.\n<\/p>\n<p>        It appears from the impugned order dated 27.5.2008<\/p>\n<p>passed in Complaint Case No.451(C) of 2006 that on going<\/p>\n<p>through the depositions of the three witnesses, examined<\/p>\n<p>before the charge, the learned Judicial Magistrate, has come<\/p>\n<p>to the conclusion that there is sufficient material against the<\/p>\n<p>accused-petitioners for framing the charge and, accordingly,<\/p>\n<p>rejected the petition filed on behalf of the accused-petitioners<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>       under Section 245 of the Code of Criminal Procedure to<\/p>\n<p>       discharge them.\n<\/p>\n<p>               I find no illegality in the impugned order dated<\/p>\n<p>       27.5.2008 passed by the Judicial Magistrate, Ist Class,<\/p>\n<p>       Danapur, in Complaint Case No.451(C) of 2006, to interfere<\/p>\n<p>       with the same in inherent jurisdiction under Section 482 of<\/p>\n<p>       the Code of Criminal Procedure.\n<\/p>\n<p>               Accordingly, this application stands dismissed.<\/p>\n<p>                                 (Rajendra Kumar Mishra, J)<\/p>\n<p>P.S.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Baleshwar Prasad Sharma &amp; Ors vs The State Of Bihar &amp; Anr on 17 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.22559 of 2008 1.
