Writ Petition No.16360 of 1997\n     Sukhram Mathuria Vs. U.P. Financial Corporation &amp; Ors.\n\nHon. Sunil Ambwani, J.\n<\/pre>\n<p>Hon. Kashi Nath Pandey, J.\n<\/p>\n<p>1.     We have heard Shri W.H. Khan, Senior Advocate assisted<br \/>\nby Shri J.H. Khan for the petitioner.\n<\/p>\n<p>2.     The petitioner was appointed as Asstt. Manager (Technical)<br \/>\nin U.P. Financial Corporation in December, 1986. When he was<br \/>\nposted in the Regional Office, Kanpur in the year 1988, his wife<br \/>\nfell ill and had to undergo a surgical operation. The petitioner<br \/>\nsubmitted a medical claim for reimbursement. The department<br \/>\nfound some discrepancy in the bill and instead of checking the bill<br \/>\nand making the payment of the amount, the petitioner was placed<br \/>\nunder suspension by the Managing Director on 26th July, 1988 with<br \/>\ndisciplinary proceedings contemplated against him. He was served<br \/>\nwith charge sheet on 28th July, 1988 for submitting medical claim in<br \/>\nexcess of the amount paid to the nursing home. After a prolonged<br \/>\ndisciplinary proceedings of eight months, the petitioner was<br \/>\npunished with a censure entry and withholding of three increments,<br \/>\nwith cumulative effect vide order dated 31st March, 1989.\n<\/p>\n<p>3.     In the year 1988-89 an adverse entry was also recorded in<br \/>\nthe petitioner&#8217;s character roll. He was also communicated with<br \/>\nadverse remarks recorded in the character roll for the year 1993-94<br \/>\nby letter dated 29.11.1996, after a period of three years.        A<br \/>\nrepresentation against the adverse entry of the year 1993-94 is said<br \/>\nto be still pending.\n<\/p>\n<p>4.     Shri W.H. Khan appearing for the petitioner submits that a<br \/>\ncriminal case was also lodged against the petitioner for false<br \/>\nmedical claims in which by order of the Munsif Magistrate-VIII,<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>Kanpur Nagar the petitioner was acquitted        of the charges on<br \/>\n7.1.1991.\n<\/p>\n<p>5.     It is stated that Shri R.M. Sethi, I.A.S. took over the charge<br \/>\nas Managing Director in August, 1994 and circulated a letter to all<br \/>\nthe employees and officers of the Corporation, to generate sense of<br \/>\nconfidence that if they have any difficulty and problem, they can<br \/>\napproach him. The petitioner filed a representation to the Managing<br \/>\nDirector to redress his grievances both against the punishment<br \/>\norder dated 31.3.1989 and the adverse entry of the year 1988-89.<br \/>\nShri Khan states that the representation addressed as appeal dated<br \/>\n10.10.1994 was filed, and is still pending. Shri Sethi, however, was<br \/>\ntransferred and thereafter nothing was done in the matter. The<br \/>\npetitioner was, thereafter, superseded by the persons, junior to him<br \/>\nnamely Shri Virendra Kumar Kanaujia and Shri B.P. Kem on<br \/>\naccount of punishment order and adverse entries.\n<\/p>\n<p>6.     The punishment order dated 31st March, 1989 shows that<br \/>\nafter giving reasonable opportunity with regard to allegations of<br \/>\nsubmitting a fake claim of medical expenses for reimbursement the<br \/>\npetitioner was given reasonable opportunity to defend the charges.<br \/>\nThe Board of Directors considered and agreed with the report of the<br \/>\nenquiry officer and imposed punishment under Regulation 40 (1)<br \/>\nof the U.P.F.C. (Staff) Regulations, with directions to withdraw the<br \/>\nsuspension order and to censure him for committing act of cheating<br \/>\nand criminal breach and trust with the Corporation in claiming the<br \/>\nmedical reimbursement for the treatment of his wife. The Board of<br \/>\nDirectors also decided to withhold three increments w.e.f. 1.4.1989<br \/>\nwith cumulative effect and to reject the claim for medical<br \/>\nreimbursement.      The order passed by the Board of Directors<br \/>\nbecame final, as it was not challenged by the petitioner.\n<\/p>\n<p>7.     The criminal case No.2470 of 1989, State Vs. Sukhram<br \/>\nMathuria under Section 218\/420 IPC resulted into acquittal on the<br \/>\nfindings that the prosecution could not prove that the petitioner has<br \/>\nnot paid Rs.115\/- towards pathology test; there was delay of 9 days<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>in filing the FIR and that the facts alleged in the FIR prima facie<br \/>\nappear to be doubtful. The petitioner did not take any steps to<br \/>\nchallenge the punishment order either before the Board of Directors<br \/>\nor before any adjudicatory forum after his acquittal on 7.1.1991.\n<\/p>\n<p>8.     The petitioner was awarded an adverse entry in his character<br \/>\nroll by the Chief Manager (Administration) by order dated<br \/>\n28\/29.12.1989 as follows:-\n<\/p>\n<blockquote><p>       &#8220;Discipline :         He should be more disciplined in office<br \/>\n                             and should not indulge in loose talk<br \/>\n                             against his Seniors.&#8221;\n<\/p><\/blockquote>\n<p>9.     The circular letter of Shri R.M. Sethi, I.A.S. was sent to the<br \/>\nemployees to generate a sense of confidence amongst them. The<br \/>\ncircular letter cannot be treated to have extended the limitation or<br \/>\nproviding a fresh opportunity for filing representation or appeal for<br \/>\nadjudication.   The punishment orders and the adverse entry of the<br \/>\nyear 1988-89, have become final and could be relied upon for<br \/>\ndenying promotion to the petitioner.\n<\/p>\n<p>10.    The petitioner also received an adverse entry in his character<br \/>\nroll on 29.11.1996 for the year 1993-94 with remarks that the<br \/>\nspeed of his disposal is slow. His relationship with colleagues,<br \/>\nsuperiors, industry initiative, devotion to duty, discipline and<br \/>\npunctuality is poor and that he has negative attitude. He was also<br \/>\nto make representation against the order.       It is stated that the<br \/>\nrepresentation was filed on 4.1.1997, and is still pending.\n<\/p>\n<p>11.    Shri W.H. Khan would submit that under the U.P.<br \/>\nGovernment Servant ( Disposal of Representation against Adverse<br \/>\nAnnual Confidential Reports and Allied Matters) Rules, 1995<br \/>\napplicable to the employees of U.P. Financial Corporation under<br \/>\nresiduary clause of Regulations, if the representation has not been<br \/>\ndecided, under rule 5 of the Rules of 1995 the report cannot be<br \/>\ntreated as adverse for the purposes of promotion crossing of<br \/>\nefficiency bar and other service matters of the government servant<br \/>\nconcerned. He has relied upon the judgment in Mata Prasad<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>Gupta Vs. State of U.P. &amp; Ors., 2009 (1) ADJ 172 (DB); Surjit<br \/>\nGhosh       Vs.   Chairman   &amp;    Managing    Director,   United<br \/>\nCommercial Bank &amp; Ors., JT 1995 (2) SC 74; and G.M. Tank<br \/>\nVs. State of Gujarat &amp; Anr., AIR 2006 SC 2129 in support of<br \/>\nhis submissions.\n<\/p>\n<p>12.     In the counter affidavit of Shri D.S. Lal, Deputy Senior<br \/>\nManager (Law), U.P. Financial Corporation, Allahabad it is stated<br \/>\nthat the petitioner was given adequate opportunity by the enquiry<br \/>\nofficer.    His written statement of defence was       taken into<br \/>\nconsideration and that against the order of Board of Director<br \/>\nreview lies under Regulation 48 of the U.P.F.C. Staff Regulations.<br \/>\nNo appeal was maintainable against the order. The petitioner did<br \/>\nnot prefer any review application.    In para 15 of the counter<br \/>\naffidavit it is stated that the petitioner has    withdrawn the<br \/>\nrepresentation in his own judgment without any threat or pressure<br \/>\nexercised by the Corporation. His appeal\/ representation was thus<br \/>\nnot maintainable and was even otherwise not in accordance with<br \/>\nthe UPFC Staff Regulation, 1961.        He was considered for<br \/>\npromotion to the post of Manager (Technical) but was not found fit<br \/>\nand that the communication to that effect was sent to him and is<br \/>\nadmitted.\n<\/p>\n<p>13.     We have carefully examined the proceedings in which<br \/>\npunishment awarded to the     petitioner, and the adverse entries<br \/>\nrecorded against him in his service record. The petitioner did not<br \/>\nprefer any review or representation and further did not go to any<br \/>\nadjudicatory forum against the order of his punishment imposed<br \/>\nupon him. He was given sufficient opportunity of submitting his<br \/>\nreply in the departmental proceedings. He was acquitted        on<br \/>\ninsufficient evidence of having produced fake bills and delay in<br \/>\nlodging FIR.\n<\/p>\n<p>14.     The petitioner acquiesced to the orders of punishment and<br \/>\nadverse entry of the year 1988-89. His conduct reflected in the<br \/>\npunishment order and adverse entry, thus could be relied upon by<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>the Corporation to deny him promotion and to supersede him by<br \/>\nhis juniors.\n<\/p>\n<p>15.    In Mata Prasad Gupta&#8217;s (Supra) case, a special appeal filed<br \/>\nby him against the judgment dismissing the writ petition and<br \/>\nupholding the punishment order, was allowed. The High Court<br \/>\ndirected his promotion to be considered on which the department<br \/>\nhad passed an order giving notional promotion to him from the<br \/>\ndate his immediate juniors were promoted. In Surjit Ghosh (Supra)<br \/>\nthe appellate authority had passed the order of punishment taking<br \/>\naway his right to file appeal and in G.M. Tank (Supra) case the<br \/>\npetitioner was honorably acquitted by the criminal court from the<br \/>\ncharges on which he was punished by the department. All the<br \/>\nthree decisions are not applicable to the facts of the present case.\n<\/p>\n<p>16.    With regard to petitioner&#8217;s representation against adverse<br \/>\nentry of the year 1993-94, the allegations that he was<br \/>\ncommunicated with the order dated 29.11.1996 after a period of 3<br \/>\nyears has been denied in para 20 of the counter affidavit. The<br \/>\nrepresentation dated 4.1.1997 was filed much after the period of 45<br \/>\ndays after communication of the entry and thus Rule 5 of the Rules<br \/>\nof 1995 is not attracted.\n<\/p>\n<p>17.
