JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled, with the following prayers :-\n<\/p>\n<p>&#8220;A)\tYour<br \/>\nLordships be pleased to issue a writ of certiorari or a writ of<br \/>\nmandamus or any appropriate writ directing the<br \/>\nrespondents-particularly res. no.2 and 4 to give an appropriate<br \/>\nrelief to the  petitioner for his loss-damage in the flood in the<br \/>\nyear 2005 and also direct to the respondents to consider his case<br \/>\nsympathetically for doing necessary.\n<\/p>\n<p>B)\tBe<br \/>\npleased to grant any other and further relief\/s which may deem fit<br \/>\nand proper in the interest of justice.&#8221;\n<\/p>\n<p>2.\tBriefly<br \/>\nstated, the case of the petitioner is that he had got a contract from<br \/>\nBhal Vikas Trees Manufacturing Co-operative Society Limited of<br \/>\nvillage Mitali, Taluka: Khambhat,<br \/>\nDistrict: Anand, vide Resolution No.286 for cutting of Baval trees<br \/>\nfrom 80 acres of land for the purpose of preparing coal. The<br \/>\npetitioner had kept for 475 bags of coal and other goods on the land.<br \/>\nIn the year 2005, there was a flood in the Sabarmati river during the<br \/>\nmonsoon season, which resulted in washing away the bags of coal,<br \/>\nhouse and other accessories of the petitioner. According to the<br \/>\npetitioner, he suffered a loss of Rs.7,19,000\/-(Rupees Seven Lacs<br \/>\nNineteen Thousand). Accordingly, a representation was made by the<br \/>\npetitioner to the District Collector which<br \/>\nwas forwarded to the Deputy Superintendent of Police, Anand for<br \/>\nnecessary inquiry. Thereafter, the case of the petitioner was<br \/>\nprocessed by the authorities. Vide letter dated 13.01.2011, the<br \/>\nDeputy Secretary, Revenue Department advised the petitioner to file<br \/>\nan appeal before the Relief Commissioner, within a period of thirty<br \/>\ndays, if not satisfied with the proceedings. It is the case of the<br \/>\npetitioner that he has filed an appeal within the stipulated period<br \/>\nof time. However, there is no decision or response to the same by the<br \/>\nRelief Commissioner. Hence the petition.\n<\/p>\n<p>3.\tAt<br \/>\nthe outset, Mr. Vasant S. Shah, learned advocate for the petitioner<br \/>\nsubmits that the interest of justice would be met, if the Relief<br \/>\nCommissioner is directed to decide the appeal filed by the petitioner<br \/>\nafter giving him an opportunity of hearing, within a stipulated<br \/>\nperiod of time.\n<\/p>\n<p>4.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>(a)\tIf<br \/>\nthe appeal of the petitioner has not already been decided, the Relief<br \/>\nCommissioner shall consider and decide the same, in accordance with<br \/>\nlaw, after affording the petitioner an opportunity of hearing.\n<\/p>\n<p>(b)\tThe<br \/>\ndate of hearing shall be intimated to the petitioner, within a period<br \/>\nof two weeks from the date of receipt of the copy of this order.\n<\/p>\n<p>(c)\tAfter<br \/>\nhearing the petitioner, the Relief Commissioner shall decide the<br \/>\nappeal within a period of four weeks from the date of hearing.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>5.\tThe<br \/>\npetition is disposed of, in the above terms.
