DEVENDRA SAH\n                                              Versus\n                          THE STATE OF BIHAR\n                                  -----------\n<\/pre>\n<p>03   28.02.2011               Both the above stated Cr. Misc. Cases arise out of<\/p>\n<p>                     Piprahi P.S. Case No. 40 of 2010 registered under Sections 147,<\/p>\n<p>                     148, 149, 379, 323, 307, 302 and 504 of the Indian Penal Code<\/p>\n<p>                     and accordingly, both the above stated petitions are being<\/p>\n<p>                     disposed of by this common order.\n<\/p>\n<p>                                 Heard learned counsel for the petitioner as well as<\/p>\n<p>                     learned Additional Public Prosecutor for the State assisted by<\/p>\n<p>                     learned counsel for the informant.\n<\/p>\n<p>                                 There is allegation against petitioner in Cr. Misc. No.<\/p>\n<p>                     1636 of 2011 that he assaulted the cousin brother of the informant<\/p>\n<p>                     and he even did not touch the body of the deceased in course of<\/p>\n<p>                     above stated occurrence.\n<\/p>\n<p>                                 So far as petitioners in Cr. Misc. No. 2722 of 2011<\/p>\n<p>                     are concerned, allegedly, they assaulted the deceased with<\/p>\n<p>                     different weapons.\n<\/p>\n<p>                                 In course of hearing, learned counsel appearing for<\/p>\n<p>                     the informant points out that injured Umashankar has received<\/p>\n<p>                     one injury on his head and the opinion regarding the aforesaid<\/p>\n<p>                     injury has been kept reserved.\n<\/p>\n<p><span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>                       Allegedly, the aforesaid Umashankar was assaulted<\/p>\n<p>          with iron rod by the petitioner in Cr. Misc. No. 1636 of 2011<\/p>\n<p>          along with two other First Information Report named accused<\/p>\n<p>          persons and admittedly, only one injury has been found on his<\/p>\n<p>          head.\n<\/p>\n<p>                       In view of the aforesaid facts and circumstances, let<\/p>\n<p>          the petitioner, namely, Raghunath Sah be released on bail on<\/p>\n<p>          furnishing bail bonds of Rs. 10,000\/- (Ten Thousand) with two<\/p>\n<p>          sureties of the like amount each to the satisfaction of Sub<\/p>\n<p>          Divisional   Judicial    Magistrate,   Sheohar   at   Sitamarhi   in<\/p>\n<p>          connection with above stated Piprahi P.S. Case No. 40 of 2010.<\/p>\n<p>                       So far as petitioners in Cr. Misc. No. 2722 of 2011<\/p>\n<p>          are concerned, let the case diary along with post mortem report of<\/p>\n<p>          deceased of Piprahi P.S. Case No. 40 of 2010 be called for from<\/p>\n<p>          the court of Sub Divisional Judicial Magistrate, Sheohar at<\/p>\n<p>          Sitamarhi and list the above stated Cr. Misc.
