1.\tIt
\nwas submitted by learned counsel, Mr.Agrawal appearing for the
\npetitioner that, even as this Revision Applications were moved in
\nearly August 2008 to challenge the orders made in July 2008, the
\napplications could not be reached even for admission hearing while
\nthe trial before the trial Court is concluded and it is kept for
\nfinal argument or pronouncement of judgment on 13th
\nOctober 2008.  He further submitted that in view of recent decision
\nof the Supreme Court in  E. Micheal Raj             v.
\nIntelligence Officer, Narcotic Control Bureau<\/a>
\nreported in AIR 2008 SC 1720,
\npercentage of purity of the narcotic drug  in question was required
\nto be ascertained in the interest of justice.\n<\/p>\n
2.\tLearned
\nAPP, Mr.Kodekar appearing for the respondent submitted that in
\nabsence of record of the trial Court, it was not clear as to whether
\nand when the issue was raised before the trial Court by the
\npetitioners; and, prima facie, it
\nappears from the impugned orders that the issue was raised at the fag
\nend of the trial.\n<\/p>\n
3.\tHence,
\nRule returnable on 20th October 2008.  Learned APP,
\nMr.Kodekar waives service.  In the meantime, Record and Proceedings
\nof the trial Court shall be called for so as to reach this Court on
\nthat date.  Direct service is permitted.\n<\/p>\n
