SHAH\n\t\t\n\t\n\n \n\nDate\n: 12\/10\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\npetitioner has prayed for an appropriate writ, direction or order<br \/>\nquashing and setting aside the impugned judgment and award dated<br \/>\n23.07.2007 passed by the Labour Court, Nadiad in Reference (LCN)<br \/>\nNo.46\/1999, by which the Labour Court has rejected\/dismissed the said<br \/>\nreference.\n<\/p>\n<p>2.\tA<br \/>\ndepartmental inquiry was initiated against the petitioner for the<br \/>\ncharge and misconduct of not issuing ticket to one passenger and<br \/>\nthough fare was collected but the ticket was not issued to one<br \/>\npassenger.  Despite the fact that opportunities were given to the<br \/>\npetitioner, he did not participated in the inquiry and even he did<br \/>\nnot file reply to the charge-sheet.  That thereafter the inquiry<br \/>\nofficer held that the charge and misconduct alleged against the<br \/>\npetitioner came to be proved.  That thereafter show cause notice was<br \/>\nissued by the Disciplinary Authority, which could not be served upon<br \/>\nthe petitioner as he was not available.  It is to be noted that even<br \/>\npetitioner remained absent without leave at the time when the<br \/>\ndepartmental inquiry was going on and the show cause notice was<br \/>\nissued and the whereabouts of the petitioner were not known to the<br \/>\nCorporation.  That thereafter the Disciplinary Authority passed an<br \/>\norder dismissing the petitioner from service.  That without<br \/>\npreferring any statutory appeals, straightway petitioner raised<br \/>\nindustrial dispute challenging his termination\/dismissal which was<br \/>\nreferred to the Labour Court, Nadiad, which was numbered as Reference<br \/>\n(LCN) No.46\/1999 and the Labour Court by impugned judgment and award<br \/>\nhas dismissed\/rejected the said reference.  Hence, petitioner has<br \/>\npreferred the present Special Civil Application under Article 227 of<br \/>\nthe Constitution of India challenging the aforesaid judgment and<br \/>\naward passed by the Labour Court, Nadiad.\n<\/p>\n<p>3.\tShri<br \/>\nMansuri, learned advocate appearing on behalf of the petitioner has<br \/>\nvehemently submitted that as petitioner could not defend the case<br \/>\nproperly, it is requested to remand the matter to the Labour Court.<br \/>\nIt is submitted that even otherwise, out of four past misconducts,<br \/>\nthree were with respect to unauthorized absence and this was the<br \/>\nfirst misconduct committed by the petitioner and therefore, the<br \/>\nLabour Court ought to have exercised the jurisdiction under Section<br \/>\n11A of the Industrial Disputes Act, 1947 and ought to have interfered<br \/>\nwith the order of punishment imposed by the Disciplinary Authority.\n<\/p>\n<p>4.\tHaving<br \/>\nheard Shri Mansuri, learned advocate appearing on behalf of the<br \/>\npetitioner and considering the impugned judgment and award, at the<br \/>\noutset it is required to be noted that as such there is a delay of<br \/>\nthree years in preferring the present Special Civil Application,<br \/>\nwhich is not properly explained.  Even otherwise on merits also,<br \/>\npetitioner has no case.  It is to be noted that petitioner did not<br \/>\nparticipate in the departmental inquiry and even did not submit his<br \/>\nreply to the charge-sheet.  That thereafter the charge and misconduct<br \/>\nalleged against the petitioner of not issuing ticket to one passenger<br \/>\nand not issuing ticket to one another passenger though the fare was<br \/>\ncollected, came to be proved.  Thereafter the show cause notice was<br \/>\nsought to be served upon the petitioner, however, he could not be<br \/>\nserved as he was neither available at his residence nor resumed the<br \/>\nduty and at the relevant time, he was again absent from duty without<br \/>\nleave.  Considering the aforesaid facts and circumstances, when the<br \/>\ncharge and misconduct alleged against the petitioner came to be<br \/>\nproved, it cannot said that the Disciplinary Authority had committed<br \/>\nany illegality in dismissing the petitioner from service.  It is to<br \/>\nbe noted that in fact petitioner did not prefer the departmental<br \/>\nappeals and straightway raised an industrial dispute.  Considering<br \/>\nthe impugned judgment and award passed by the Labour Court, no case<br \/>\nis made out to interfere with the same in exercise of powers under<br \/>\nArticle 227 of the Constitution of India.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above and for the reasons stated above, there is no<br \/>\nsubstance in the petition, which deserves to be dismissed and is,<br \/>\naccordingly, dismissed.\n<\/p>\n<p>(M.R.\n<\/p>\n<p>Shah, J.)<\/p>\n<p>*menon\t<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Dalpatbhai vs S on 12 October, 2010 Author: M.R.
