MANOHAR\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This is  an astonishing  and more\tshocking  case.\t The<br \/>\npetitioner who\twas, admittedly,  to retire  on May 31, 1991<br \/>\nremained in  office till  May 31,  1994 as  if he was not to<br \/>\nretire from service, enjoying all the benefit of service.\n<\/p>\n<p>     This special  leave petition  arises from\tthe order of<br \/>\nthe Central  Administrative Tribunal,  Patna Bench,  made on<br \/>\nNovember 26,  1996 in  OA No.  652\/95.\tThe  petitioner\t has<br \/>\njoined\tthe   service  in  Tele\t Communications\t Department.<br \/>\nAdmittedly, his\t date of birth is May 13, 1933. On attaining<br \/>\nthe age of superannuation, he was to retire on May 31, 1991.<br \/>\nInstead, he  remained in  service till\tMay 31,\t 1994.\tWhen<br \/>\naction was  taken to recover the amounts paid to him for the<br \/>\nperiod beyond  the date\t he was to retire viz., May 31, 1991<br \/>\nand to\twhich he  was not  entitled,  he  filed\t OA  in\t the<br \/>\nTribunal and the same has been dismissed. Thus, this special<br \/>\nleave petition.\n<\/p>\n<p>     The learned  counsel for  the petitioner  contends that<br \/>\nsince the  petitioner has  worked during  the period,  he is<br \/>\nentitled to  the payment  of the  pay  and  allowances\tfrom<br \/>\n1.6.1991 to  26.6.1994 and  that the is also entitled to the<br \/>\npayment\t  of   Provisional   Pension,\tDeath-cum-retirement<br \/>\ngratuity, leave\t encashment commutation\t of pension  amount,<br \/>\nGPF money and the amount deposit under CGHS on the plea that<br \/>\nhe retired  from service  on May  31, 1994. We are aghast to<br \/>\nnotice the  boldness  with  which  it  is  claimed  that  he<br \/>\nentitled to  all the benefits with effect from the abovesaid<br \/>\ndate when  admittedly he  was to  retire on May 31, 1991. It<br \/>\nwould be an obvious case of absolute irresponsibility on the<br \/>\npart of\t the officer  concerned in  the Establishment in the<br \/>\nconcerned section  for not  taking any\taction to  have\t the<br \/>\npetitioner   retired   from   service\ton   his   attaining<br \/>\nsuperannuation. It is true that the petitioner worked during<br \/>\nthat period, but when he is not to continue to be in service<br \/>\nas per\tlaw, he\t has no right to claim the salary etc. It is<br \/>\nnot the\t case  that    he  was\tre-employed  in\t the  public<br \/>\ninterest,  after   attaining  superannuation.\tUnder  these<br \/>\ncircumstances, we  do not  find any illegality in the action<br \/>\ntaken by the authorities in refusing to grant the benefits.\n<\/p>\n<p>     It is  then contended  that the  petitioner would\thave<br \/>\nconveniently secured gainful employment elsewhere and having<br \/>\nworked, he  cannot be  denied of  the legitimate  salary  to<br \/>\nwhich he  is entitled  to . Though the argument is alluring,<br \/>\nwe cannot  accept the  contention and give legitimacy to the<br \/>\nillegal action\ttaken by  the authorities. If the contention<br \/>\nis given  acceptance, it would be field day for manipulation<br \/>\nwith impugnity\tand one would get away on the plea of equity<br \/>\nand misplaced  sympathy. It  cannot and\t should not be given<br \/>\ncountenance.\n<\/p>\n<p>     Under those circumstances, we dismiss the petition with<br \/>\na direction  to the  Government of India to take appropriate<br \/>\ndisciplinary action  against all  the persons  concerned for<br \/>\ntheir deliberate  dereliction of  duty in  not ensuring\t the<br \/>\npetitioner&#8217;s  retirement   on  his   attaining\tthe  age  of<br \/>\nsuperannuation.\n<\/p>\n<p>     The Ragistry  is directed\tto communicate this order to<br \/>\nthe Secretary , Telecommunications, Government of India. The<br \/>\nSecretary is  directed to  ensure immediate  action  in\t the<br \/>\nmatter and  submit the compliance report to the Registrar of<br \/>\nthis Court  within three months from the date of the receipt<br \/>\nof this order.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Radha Kishun vs Union Of India &amp; Ors on 28 February, 1997 Bench: K.
