M. SAHAI)<\/p>\n<p>\tBy<\/a><br \/>\nway of filing this appeal the appellant &#8211; original petitioner<br \/>\nhas challenged the order dated 20th<br \/>\nOctober 2004 passed by the learned Single Judge<br \/>\nin Special Civil Application No.11235 of 2004 vide which he dismissed<br \/>\nthe writ petition filed by the appellant  &#8211; original petitioner.\n<\/p>\n<p>2.\tThe<br \/>\nshort facts of the appeal are that the respondent-workman was working<br \/>\nas a peon with the appellant-bank.  He was dismissed from service<br \/>\nwith effect from 13th<br \/>\nMay 1980 as he is alleged to have committed  misconduct of cheating<br \/>\nthe members and customers of the appellant-bank.   The<br \/>\nrespondent-workman raised the industrial dispute challenging the<br \/>\naction of the appellant-bank and the same was registered as BIR<br \/>\nApplication No.70 of 1980 before the Labour Court, Junagadh.\n<\/p>\n<p>3.\tThe<br \/>\nLabour Court, after hearing both the parties came to the conclusion<br \/>\nthat the action of the appellant-bank in dismissing the services of<br \/>\nthe respondent-workman was legal and valid and thereby rejected the<br \/>\napplication made by the respondent-workman.\n<\/p>\n<p>4.\tThe<br \/>\nrespondent-workman, therefore, filed appeal before the Industrial<br \/>\nCourt, Rajkot being Appeal (IC) No.9 of 1986.  The Industrial Court,<br \/>\nafter hearing the parties, confirmed the order of the Labour Court by<br \/>\nholding that the dismissal of the respondent-workman was legal and<br \/>\nvalid, but directed the appellant-bank to pay the subsistence<br \/>\nallowance  from the date of dismissal till the date of order of the<br \/>\nLabour Court i.e. from 13th<br \/>\nMay 1980 to 9th<br \/>\nJuly 1986.\n<\/p>\n<p>5.\tFeeling<br \/>\naggrieved by the aforesaid order of the Industrial Court, the<br \/>\nappellant-bank challenged the same before the learned Single Judge on<br \/>\nvarious grounds.  The learned Single Judge by the impugned order<br \/>\ndated 20th October<br \/>\n2004 rejected the writ petition filed by the appellant-bank.  Hence,<br \/>\nthe present appeal.\n<\/p>\n<p>6.\tHeard<br \/>\nlearned counsel for the appellant and perused the record.   The<br \/>\nlearned counsel for the appellant submitted that pending the<br \/>\napplication before the Labour Court after the dismissal order the<br \/>\nworkman is not entitled for the back-wages and in support of his<br \/>\ncontention he relied upon the decision of the Apex Court in the case<br \/>\nof  D.C. Roy v. Presiding Officer of the Labour<br \/>\nCourt &amp; Anr.,<br \/>\nreported in AIR 1976 SC 1760.\n<\/p>\n<p>7.\tWe<br \/>\nare of the view that the Industrial Court as well as the learned<br \/>\nSingle Judge have erred in awarding subsistence allowance to the<br \/>\nrespondent-workman from the date of dismissal till the date of order<br \/>\nof the Labour Court i.e. from 13th<br \/>\nMay 1980 to 9th<br \/>\nJuly 1986.
