Justice PIUS C.KURIAKOSE\n\n Dated :29\/03\/2007\n\n O R D E R\n                         PIUS C.KURIAKOSE, J.\n\n                    ----------------------------------\n\n                        R.P.NO. 356  of    2007\n\n                    ----------------------------------\n\n               Dated this    29th day of  March, 2007\n\n\n                                  O R D E R\n<\/pre>\n<p>        Heard Sri.M.K.Chandramohan Das, the learned counsel for<\/p>\n<p>the petitioner,  Sri.M.K.Aboobacker, the learned Standing Counsel<\/p>\n<p>for the  Calicut Development Authority and Sri.Prabhanandan, the<\/p>\n<p>learned Standing Counsel for the Calicut Corporation.\n<\/p>\n<p>      2. Notwithstanding the   persuasive submissions were made<\/p>\n<p>by   Sri.Chandramohan   Das,   I   do   not   think   that   there   is   any<\/p>\n<p>warrant   for   review   my   judgment,   wherein     the     petitioners   are<\/p>\n<p>directed to file undertaking in the form of an affidavit in the wake<\/p>\n<p>of   the   assertion   by   the   counsel   for   the   Development   Authority<\/p>\n<p>and   the   Corporation   that   there   is   a   proposal   to     acquire   the<\/p>\n<p>property   of   the   petitioners   in   implementation   of   the   dream   city<\/p>\n<p>project.\n<\/p>\n<p>      I have considered the principles laid down by the Supreme<\/p>\n<p><span class=\"hidden_text\">R.P. No.356\/2007                        2<\/span><\/p>\n<p>Court in   <a href=\"\/doc\/1755100\/\">Raju Jethmalani &amp; others v. State of Maharashtra<\/p>\n<p>&amp;   others<\/a>  (2005   11   SCC   222)   and     imposed   condition   that   an<\/p>\n<p>affidavit shall be filed by the petitioners to the effect that in the<\/p>\n<p>event of    the land  being acquired within  a period  of 15 months<\/p>\n<p>from the date of issuance of permit by the 2nd  respondent, they<\/p>\n<p>will   surrender   the   property   together   with   the   building   without<\/p>\n<p>claiming any compensation for     the building constructed on the<\/p>\n<p>strength   of   the   permit.       In   other   words,   what   this   court   has<\/p>\n<p>indicated is  that the petitioners were taking risk in the matter of<\/p>\n<p>constructing the building.  The learned counsel for the petitioners<\/p>\n<p>submitted   that   if   the   judgment   is   allowed   to   operate,   the<\/p>\n<p>petitioners will not  be getting even  compensation for the land in<\/p>\n<p>the event of acquisition within 15 months.
