Dave for the applicant referred to the FIR and<br \/>\n\tsubmitted that the applicant is not involved in procuring the job<br \/>\n\tand has not been received any amount. He further submitted that the<br \/>\n\tallegation is that he had introduced other persons\/co-accused and,<br \/>\n\ttherefore, as now the chargesheet has been filed, the present<br \/>\n\tapplication may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Ms.Shah resisted the present application and submitted that<br \/>\n\the impersonated himself has office bearer of the congress party and<br \/>\n\thas not been arrested for about three years, for which, warrant came<br \/>\n\tto be issued.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel appearing for the applicant-accused and<br \/>\n\tlearned A.P.P. for the State  and having considered the nature of<br \/>\n\toffence, manner in which it is alleged to have been committed, role<br \/>\n\tattributed, prima-facie case suggested. However, as now the<br \/>\n\tchargesheet has been filed and other co-accused have been released<br \/>\n\ton bail, the present application deserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.36\/2007<br \/>\n\tregistered with Mansa Police Station on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the  trial<br \/>\ncommences.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
