Heard learned counsel appearing for the petitioner and<\/p>\n<p>            learned counsel appearing for the State.\n<\/p>\n<p>                   Learned counsel appearing for the petitioner submits that<\/p>\n<p>            earlier in the writ application the informant was impleaded as<\/p>\n<p>            respondent no.2 inadvertently as the case arising of a police case is<\/p>\n<p>            well represented through the State of Jharkhand on whose behalf<\/p>\n<p>            even a counter affidavit has been filed and, therefore, the<\/p>\n<p>            petitioner thought it proper to delete the name of the informant<\/p>\n<p>            (respondent no.2) as the informant is being well represented by<\/p>\n<p>            the State of Jharkhand and the disposal of the case would be<\/p>\n<p>            delayed, on account of non-service of notice upon respondent no.2<\/p>\n<p>            and, therefore, under this situation, prayer has been made to<\/p>\n<p>            delete the name of respondent no.2.\n<\/p>\n<p>                   In the facts and circumstances as stated above, the name of<\/p>\n<p>            respondent no.2 is allowed to be deleted from the memo of<\/p>\n<p>            application.\n<\/p>\n<p>                   Accordingly, the prayer is allowed.\n<\/p>\n<p>                   Heard learned counsel appearing for the petitioner        and<\/p>\n<p>            learned counsel appearing for the State on the merit of the case.<\/p>\n<p>                   This application has been filed for quashing of the entire<\/p>\n<p>            criminal proceedings including the first information report of Kandra<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>P.S. case no.6 of 2009 (G.R.No.654 of 2009) registered under<\/p>\n<p>Sections 285, 287, 337, 338,304A of the Indian Penal Code.<\/p>\n<p>       The facts giving rise this application are that one Anuj<\/p>\n<p>Kumar Yadav gave his Fardbeyan on 17.8.2009 stating therein that<\/p>\n<p>while he was working along with others, namely, Kumud Rai,<\/p>\n<p>Lakhan Kumar and Pintu Nadaf as labourers at Induction Furnace<\/p>\n<p>Site, a unit of M\/s.Adhunik Alloys &amp; Power Limited, power supply<\/p>\n<p>went off suddenly, as a result of which molten slag spilled out of<\/p>\n<p>bucket as a result of which they sustained burn injuries. They were<\/p>\n<p>immediately removed to hospital but unfortunately Kumud Rai<\/p>\n<p>succumbed to his injuries. Thus, it has been alleged that aforesaid<\/p>\n<p>occurrence took place as the Company never cared to take safety<\/p>\n<p>measures, though they were working at dangerous places.<\/p>\n<p>       On the said Fardbeyan, Kandra P.S. case no.6 of 2009 was<\/p>\n<p>registered under Sections 285, 287, 337, 338,304A of the Indian<\/p>\n<p>Penal Code. The said prosecution has been challenged in this writ<\/p>\n<p>application.\n<\/p>\n<p>       Learned counsel appearing for the petitioner submits that<\/p>\n<p>the entire allegation made in the first information report falls within<\/p>\n<p>the ambit of the provision as contained in Section 92 of the<\/p>\n<p>Factories Act and, therefore, if any prosecution on account of<\/p>\n<p>negligence on the part of the Management of the said factory lies<\/p>\n<p>that lies under the Factories Act which is a special legislation and<\/p>\n<p>as such, provision of the said Act would prevail over the provision<\/p>\n<p>of the general law.\n<\/p>\n<p>       It was pointed out that when similar question arose before<\/p>\n<p>this Court for consideration in a case of Binod Kumar Das and<\/p>\n<p>another vs. State of Jharkhand and another [2008(1) JCR<\/p>\n<p>601 (Jhr)], this Court taking into consideration the provision as<\/p>\n<p>contained in Section 4 of the Code of Criminal Procedure did hold<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>      that prosecution under the general law on the allegation which falls<\/p>\n<p>      within the province of the special legislation is not permissible.<\/p>\n<p>      Similar is the case here as the allegation, upon which first<\/p>\n<p>      information report was lodged certainly falls within the ambit of<\/p>\n<p>      Section 92 of the Factories Act and hence, any prosecution under<\/p>\n<p>      the general law that is to say under the Indian Penal Code would<\/p>\n<p>      be quite bad.\n<\/p>\n<p>            A counter affidavit has been filed on behalf of the State<\/p>\n<p>      stating therein that due to negligence on the part of the<\/p>\n<p>      Management for not adopting safety measure, the occurrence took<\/p>\n<p>      place and as such, the petitioner is being rightly prosecuted.<\/p>\n<p>            Having heard learned counsel appearing for the parties,<\/p>\n<p>      there does not appear to be any doubt that the allegations upon<\/p>\n<p>      which first information report was lodged, come well within the<\/p>\n<p>      ambit of the provision as enshrined under Section 92 of the<\/p>\n<p>      Factories Act and as such, any prosecution under the general law in<\/p>\n<p>      view of Section 4     of the Code of Criminal Procedure is not<\/p>\n<p>      permissible which proposition of law has already been laid down in<\/p>\n<p>      a case of Binod Kumar Das and another vs. State of<\/p>\n<p>      Jharkhand and another (supra).\n<\/p>\n<p>            Accordingly, the first information report of Kandra P.S. case<\/p>\n<p>      no.6 of 2009 (G.R.No.654 of 2009) registered under Sections 285,<\/p>\n<p>      287, 337, 338,304A of the Indian Penal Code is hereby quashed.<\/p>\n<p>            In the result, this application is allowed.\n<\/p>\n<\/p>\n<p>                                                          ( R.R.Prasad, J.)<br \/>\nND\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Jharkhand High Court Rabindra Agarwal vs State Of Jharkhand &amp; Anr on 24 February, 2010 In the High Court of Jharkhand at Ranchi W.P.(Cr.)
