Justice K.T.SANKARAN\n\n Dated :05\/10\/2010\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.30491  OF 2010\n          ------------------------------\n                      th\n      Dated this the 5  day of October, 2010\n\n\n\n                     JUDGMENT\n<\/pre>\n<p>    In the manner which I propose to dispose of the<\/p>\n<p>Writ Petition, I do not think it is necessary to<\/p>\n<p>                 th<br \/>\nissue notice to 5   respondent.  G.P. takes notice<\/p>\n<p>for respondents 1 to 4.\n<\/p>\n<p>    2. The case of the petitioner is that he was<\/p>\n<p>appointed as Full Time Menial in Deepthi High<\/p>\n<p>School,  Thalore,  in  the  promotion  vacancy   of<\/p>\n<p>P.J.Wilson  for   the  period   from  3.8.2005   to<\/p>\n<p>30.5.2010.   It is stated that the promotion of<\/p>\n<p>P.J.Wilson was approved by the District Educational<\/p>\n<p>Officer  as   per   order  dated   15.11.2005   and<\/p>\n<p>therefore,  it   is  clear   that  there   was   an<\/p>\n<p>established vacancy to accommodate the petitioner.<\/p>\n<p>However, the District Educational Officer rejected<\/p>\n<p>the proposal to approve the appointment of the<\/p>\n<p>petitioner, as per Ext.P2 order dated 14.8.2006.<\/p>\n<p>The appeal preferred against Ext.P2 was dismissed<\/p>\n<p>by Deputy Director of Education as per Ext.P3 order<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.30491 OF 2010    2<\/span><\/p>\n<p>dated 13.9.2006.       Though a revision was filed<\/p>\n<p>before the Director of Public Instruction, that was<\/p>\n<p>also dismissed as per Ext.P4 dated 11.11.2009.    The<\/p>\n<p>Manager as well as the petitioner have preferred<\/p>\n<p>revision petitions to the Government as per Exts.P5<\/p>\n<p>and P6 respectively.    It is stated that Exts.P5 and<\/p>\n<p>P6 are pending disposal.\n<\/p>\n<p>    3. Though Several reliefs are prayed for in the<\/p>\n<p>Writ   Petition,   the  counsel  for  the  petitioner<\/p>\n<p>submitted that for the time being, the petitioner<\/p>\n<p>would be satisfied, if a direction is issued to the<\/p>\n<p>first respondent to consider and dispose of Exts.P5<\/p>\n<p>and P6 Revisions, leaving open the contentions put<\/p>\n<p>forward by the petitioner.\n<\/p>\n<p>    4. Since Exts.P5 and P6 are pending disposal,<\/p>\n<p>it is not necessary to consider the merits of the<\/p>\n<p>contentions put forward by the petitioner.    In the<\/p>\n<p>facts and circumstances of the case, the first<\/p>\n<p>respondent is directed to dispose of Exts.P5 and P6<\/p>\n<p>revisions filed by the Manager and the    petitioner,<\/p>\n<p>as expeditiously as possible and at any rate within<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.30491 OF 2010   3<\/span><\/p>\n<p>a period of three months from the date of receipt<\/p>\n<p>of a copy of this judgment, after affording an<\/p>\n<p>opportunity of being heard to the petitioner and<\/p>\n<p>the fifth respondent-Manager.
