NO. 9314 OF 2010 L\n             ------------------------------------------------------\n             Dated this the 28th day of October, 2010\n\n                                JUDGMENT\n<\/pre>\n<p>       The first petitioner was appointed as Lecturer in Physics in<\/p>\n<p>M.G.College, Thiruvananthapuram as per Ext.P1 appointment order<\/p>\n<p>dated 11.11.2008. The second petitioner was appointed as Lecturer<\/p>\n<p>in Physics in M.M.N.S.S.College, Kottiam, Kollam, as per Ext.P2<\/p>\n<p>order of appointment.         The University of Kerala approved the<\/p>\n<p>proposal for appointment of the petitioners. The University assessed<\/p>\n<p>the workload and found that the petitioners could be duly appointed<\/p>\n<p>in the Colleges.\n<\/p>\n<\/p>\n<p>       2.  However, when the salary bills of the petitioners were<\/p>\n<p>prepared by the Principal and forwarded to the Deputy Director of<\/p>\n<p>Collegiate Education for obtaining his counter signature, it was not<\/p>\n<p>countersigned by the Deputy Director of Collegiate Education in the<\/p>\n<p>case of the first petitioner and it was rejected by the Deputy Director<\/p>\n<p>in the case of the second petitioner. Rejection of the salary bill of the<\/p>\n<p>second petitioner was made as per Ext.P7 on the ground that the<\/p>\n<p>concurrence of the Government was not obtained and therefore, the<\/p>\n<p>claim could not be entertained. As per Ext.P8 letter dated 29.7.2009,<\/p>\n<p>W.P.(C) NO.9314 OF 2010<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>the Deputy Director directed the Principal (7th respondent) to send<\/p>\n<p>the proposal for approval of appointment of the second petitioner.<\/p>\n<p>      3. The learned counsel for the petitioners submitted that when<\/p>\n<p>the appointment is approved by the University, the Government is<\/p>\n<p>not entitled to deny salary to the Lecturers. It is submitted that the<\/p>\n<p>issue is well settled by the decisions in Shalini Rachel v. Manager,<\/p>\n<p>Christian College (2007 (3) KLT 355) and in <a href=\"\/doc\/1487672\/\">Cherian Mathew v.<\/p>\n<p>Principal, S.B.College, Changanassery<\/a> (1998 (2) KLT 144).           In<\/p>\n<p>Shalini Rachel&#8217;s case, it was held thus:\n<\/p>\n<\/p>\n<blockquote><p>             &#8220;9.    We are of the view, above mentioned<\/p>\n<p>      provisions    of   the  University   Act,  Statutes    and<\/p>\n<p>      Ordinances would clearly indicate that it is for the<\/p>\n<p>      University to sanction the post as per clause (3) of<\/p>\n<p>      Statute 14 of the Kerala University (Conditions of<\/p>\n<p>      Service of Teachers and Members of Non-teaching<\/p>\n<p>      Staff) First Statutes, 1979 in the case of private colleges<\/p>\n<p>      coming under the Direct Payment Scheme, depending<\/p>\n<p>      upon the work load and staff pattern fixed by the<\/p>\n<p>      University. Once University accords sanction of a post<\/p>\n<p>      and grants approval depending upon the work load and<\/p>\n<p>      staff pattern, the      Deputy Director     of Collegiate<\/p>\n<p>      Education shall verify before making direct payment of<\/p>\n<p>W.P.(C) NO.9314 OF 2010<\/p>\n<p>                                    :: 3 ::\n<\/p><\/blockquote>\n<blockquote><p>      salaries as to whether the post for which payment is<\/p>\n<p>      claimed is in accordance with the staff pattern and<\/p>\n<p>      workload fixed by the University. If the University grants<\/p>\n<p>      approval noticing that it is in accordance with the staff<\/p>\n<p>      pattern and work load fixed by it, the Director of<\/p>\n<p>      Collegiate Education or the officers concerned are<\/p>\n<p>      obliged to make payment of salary as per the direct<\/p>\n<p>      payment scheme.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            10. Scope of S.57(2) of the Kerala University Act<\/p>\n<p>      has to be tested in the light of the above mentioned<\/p>\n<p>      statutory provisions. Power of the University in granting<\/p>\n<p>      approval as well as sanctioning posts after ascertaining<\/p>\n<p>      the work load and fixation of staff pattern as per the<\/p>\n<p>      Statutes has not been taken away by the University<\/p>\n<p>      Amendment Act 2 of 2005. Clear cut provisions have<\/p>\n<p>      been made in the University Statutes and Ordinances<\/p>\n<p>      as to how the work load has to be assessed and staff<\/p>\n<p>      strength fixed so as to avoid unnecessary appointments.<\/p>\n<p>      Further the interest of the students is also to be<\/p>\n<p>      safeguarded by appointing sufficient number of teachers<\/p>\n<p>      without delay. Power is also conferred on the Deputy<\/p>\n<p>      Director of Collegiate Education to take up the matter<\/p>\n<p>      with the University in case there is any doubt with the<\/p>\n<p>      approval granted.    In appropriate cases, Government<\/p>\n<p>      can also examine the action taken by the Deputy<\/p>\n<p>      Director and address the University through him.<\/p>\n<\/blockquote>\n<p>W.P.(C) NO.9314 OF 2010<\/p>\n<p>                                   :: 4 ::\n<\/p>\n<p>              11. We have no reason to think that an august<\/p>\n<p>      body like Syndicate or the Deputy Director of Collegiate<\/p>\n<p>      Education would act arbitrarily or against public interest<\/p>\n<p>      while exercising powers statutorily conferred on them.<\/p>\n<p>      Sub-s. (1) of S.57 only says that appointments to the<\/p>\n<p>      posts eligible to receive salary from the Government<\/p>\n<p>      shall be made only after getting prior sanction from or<\/p>\n<p>      from such officers authorised by the Government. For<\/p>\n<p>      filling up the posts sanctioned by the University on the<\/p>\n<p>      basis of work load or staff pattern, no prior permission of<\/p>\n<p>      the Government is necessary. Once Syndicate of the<\/p>\n<p>      University grants approval for filling up the existing<\/p>\n<p>      vacancies depending upon the workload and staff<\/p>\n<p>      pattern Government is obliged to pay salary of the<\/p>\n<p>      teachers appointed by duly constituted Selection<\/p>\n<p>      Committee. If Government or its officers find that the<\/p>\n<p>      approval was granted by the University illegally it can<\/p>\n<p>      always take up the matter before the University or other<\/p>\n<p>      forums so that public interest will not suffer. S.57(1)<\/p>\n<p>      was introduced not to take away the statutory powers<\/p>\n<p>      already conferred on the Syndicate of the University.<\/p>\n<p>      Principle laid down in Cherian Mathew&#8217;s case, supra in<\/p>\n<p>      our view, still holds good.       In view of the above<\/p>\n<p>      mentioned circumstances, we are inclined to affirm the<\/p>\n<p>      judgment of the learned single Judge in W.P.(C)<\/p>\n<p>      No.12109 of 2006 and dismiss W.A.No.940 of 2007.&#8221;<\/p>\n<p>W.P.(C) NO.9314 OF 2010<\/p>\n<p>                                        :: 5 ::\n<\/p>\n<p>       4. The decision of the Division Bench in Cherian Mathew&#8217;s<\/p>\n<p>case was followed in Shalini Rachel&#8217;s case.<\/p>\n<p>       5. In view of the binding decisions of the Division Bench, the<\/p>\n<p>Deputy Director of Collegiate Education was not justified in not<\/p>\n<p>honouring the salary bill of the second petitioner or in withholding<\/p>\n<p>the salary bill of the first petitioner. Ext.P7, to the extent it relates to<\/p>\n<p>the second petitioner, and Ext.P8 are accordingly quashed. The<\/p>\n<p>petitioners are entitled to get salary in view of the fact that their<\/p>\n<p>appointments were duly approved by the University. The Deputy<\/p>\n<p>Director of Collegiate Education shall countersign the salary bills of<\/p>\n<p>the petitioners presented to him without raising any objection that<\/p>\n<p>prior concurrence of the Government was not obtained or on the<\/p>\n<p>ground of any workload or on any other ground which will go against<\/p>\n<p>the dictum laid down in Cherian Mathew&#8217;s case and Shalini Rachel&#8217;s<\/p>\n<p>case referred to above.\n<\/p>\n<p>       The Writ Petition is allowed as above.\n<\/p>\n<\/p>\n<p>                                                      (K.T.SANKARAN)<br \/>\n                                                             Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Jayasudha S vs State Of Kerala on 28 October, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 9314 of 2010(L) 1.
