Doabia, J.<\/p>\n<p>1. The petitioner in this petition submits that in the matter of grant of seniority, his ad hoc services should be taken note of. As this is the short submission, the detailed facts are not being noticed. The relevant facts are as below :\n<\/p>\n<p>2. The petitioner was appointed as sub-engineer on 31-8-1984. The copy of the order of appointment has been placed as Annexure P\/l. The initial appointment was for a period of six months. It was extended later on. Copies of these orders are Annexures P\/2, P\/3 and P\/4. Vide order Annexure P\/3, the appointment was continued till further orders. Vide order Annexure P\/4 the appointment was extended till declaration of result of new sub-engineers. Vide Annexure P\/5 the appointment was further continued. Vide Annexure P\/6, the appointment of petitioner was regularised.\n<\/p>\n<p>3. It is not in dispute that some employees who were appointed after 31st of August, 1984 were given the seniority over and above the petitioner. The petitioner has been denied seniority on the ground that his earlier appointment was ad hoc.\n<\/p>\n<p>4. The learned counsel for the respondent has placed reliance on number of decisions. The decision reported as <a href=\"\/doc\/783639\/\">Chief of Naval Staff v. G. Gopalakrishna Pillai,<\/a> (1996) 1 SCC 521, is a decision for the proposition that if ad hoc appointment is continued without any interruption, then benefit cannot be given for seniority purposes when regular appointment is made. <a href=\"\/doc\/545861\/\">Excise Commissioner, Karnataka v. V. Sreekanta, AIR<\/a> 1993 SC 1564, is a decision for the proposition that if there are no rules and regularisation is done after framing of rules, then ad hoc period of service is not to be counted for seniority purposes. <a href=\"\/doc\/168809\/\">Food Corporation of India v. Thaneswar Kalita,<\/a> (1995) 3 SCC 342 is an authority for the proposition that ad hoc promotion cannot be taken into consideration for the purposes of giving seniority if the rules do not permit such a course to be adopted.\n<\/p>\n<p>5. I am of the opinion that the aforementioned judgments would not be attracted to the present case.\n<\/p>\n<p>6. In the instant case, there are no rules governing service conditions. Reliance has been placed on the M. P. Regularisation of ad hoc appointment Rules, 1986. These rules were framed with a view to regularise the service of civil servants holding civil post. The petitioner is an employee of State Agricultural Marketing Board, Bhopal. The Board is not shown to have adopted the aforementioned Rules.\n<\/p>\n<p>7. I am of the opinion that this is a matter which would be covered by the latest decision given by the Supreme Court in the case of <a href=\"\/doc\/1057686\/\">I.K. Sukhija v. Union of India<\/a> reported in (1997) 6 SCC 406. In this case it was held that benefit of ad hoc\/stop gap arrangement can be given when the rules are silent.\n<\/p>\n<p>8. As indicated above, rules have not been placed on record with a view to indicate as to how seniority is to be determined. The case was taken up on 21st of October, 1996. Specific order was passed directing the respondents to indicate the rule. None has been placed till today.\n<\/p>\n<p>9. Thus, the petitioner would be entitled to get ad hoc service rendered by him to be considered for seniority in view of the decision given in I.K. Sukhija (supra).\n<\/p>\n<p>10. Apart from this it be seen that vide order Annexure P\/5, the services of the petitioner were extended till further orders. The ad hoc arrangement with break in service was discontinued with effect from 10th of July, 1987. Therefore, looking from any point of view the petitioner is right in his submissions that ad hoc service be counted for seniority purpose. Let seniority be re-determined. Let this be decided within a period of six months. The petitioner would furnish the copy of this order along with writ petition and its annexures to the respondents.
