Heard        learned        counsel           appearing       on<\/p>\n<p>                    behalf of the petitioner and learned counsel<\/p>\n<p>                    appearing on behalf of the State.<\/p>\n<p>                              The      petitioner              is     in     custody        in<\/p>\n<p>                    connection with Complaint Case No.1824 of 2001<\/p>\n<p>                    for     the     offence     punishable                under     sections<\/p>\n<p>                    498A,     304B    of      the     Indian          Penal       Code    and<\/p>\n<p>                    section 4 of the Dowry Prohibition Act.<\/p>\n<p>                              Learned       counsel            for    the     petitioner,<\/p>\n<p>                    with     reference        to     the        complaint           petition<\/p>\n<p>                    placed    at     Annexure-2,          submits          that     for    the<\/p>\n<p>                    alleged       occurrence          which           took        place     on<\/p>\n<p>                    12.11.2001,        the          complaint              petition        was<\/p>\n<p>                    instituted after a lapse of almost a month on<\/p>\n<p>                    10.12.2001       and    cognizance              was    taken     in    the<\/p>\n<p>                    present case almost six years thereafter in<\/p>\n<p>                    the      year     2007.          He        submits            that     the<\/p>\n<p>                    complainant,       realizing          his        mistake       has    also<\/p>\n<p>                    filed     a     petition        before           the     court       below<\/p>\n<p>                    mentioning       that     the     case          was    instituted       on<\/p>\n<p>                    hearsay       information.            He     submits          that     the<\/p>\n<p>                    deceased was the second wife of the petitioner<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>      and that the unfortunate accident was a result<\/p>\n<p>      of an altercation between the two wives.
