No.26890 of 2010\n                       MD.IRSADU JAMMA, SON OF SAMSAD JAMA\n                                           Versus\n                                 THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   10.08.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 302, 120B and 34 of the Indian Penal<\/p>\n<p>                  Code.\n<\/p>\n<p>                             It has been submitted that the petitioner is suspected<\/p>\n<p>                  to be involved in the murder of the deceased since allegedly the<\/p>\n<p>                  petitioner had illicit relationship with the deceased.<\/p>\n<p>                             Considering that there is no eye witness to the<\/p>\n<p>                  occurrence and the petitioner has no criminal antecedents, let<\/p>\n<p>                  the petitioner above named, be released on bail on furnishing<\/p>\n<p>                  bail bond of Rs. 5,000\/- (Five thousand) with two sureties of the<\/p>\n<p>                  like amount each to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>                  Patna, in Digha P.S. Case No. 44 of 2010 subject to the<\/p>\n<p>                  following conditions: (i)That one of the bailors will be a close<\/p>\n<p>                  relative of the petitioner who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioner. The bailor<\/p>\n<p>                  will undertake to furnish information to the court about any<\/p>\n<p>                  change in address of the petitioner. (ii)That the affidavit shall<\/p>\n<p>                  clearly state that the petitioner is not an accused in any other<\/p>\n<p>                  case and if he is, he shall not be released on bail. (iii)That the<\/p>\n<p>                  petitioner will give an undertaking that he will receive the police<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        papers on the given date and be present on date fixed for<\/p>\n<p>        charge and if he fails to do so on two given dates and delays<\/p>\n<p>        the trial in any manner, his bail will be liable to be cancelled for<\/p>\n<p>        reasons of misuse.
